The business plan was submitted late on 2/15/2023 for the year of 2023. The business plan was submitted on time for the years of 2024 and 2025. This violation has been corrected on site. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a (Class 2)Violation. 12 CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for release/threatened release of hazmat OBSERVATION: The emergency response(ER) procedures were not complete. Section C6 and C7 of the emergency response and contingency plan were not completed. Section C6 and C7 need to list the name of the nearest medical facility and the phone number of the medical facility. This violation has been corrected on site. REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department(EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval.
