The business plan was submitted late on 2/15/2023 for <br /> the year of 2023. The business plan was submitted on time for the years of 2024 and 2025. This violation has been <br /> corrected on site. <br /> REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. <br /> CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the <br /> annual HMBP to CERS by January 15. <br /> This is a (Class 2)Violation. <br /> 12 CA Health and Safety Code 25505(a)(3) 1010010 - Electronically submitted adequate response plan/procedures for <br /> release/threatened release of hazmat <br /> OBSERVATION: The emergency response(ER) procedures were not complete. Section C6 and C7 of the emergency <br /> response and contingency plan were not completed. Section C6 and C7 need to list the name of the nearest medical <br /> facility and the phone number of the medical facility. This violation has been corrected on site. <br /> REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br /> or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of <br /> local emergency personnel and the Environmental Health Department(EHD) - procedures for the mitigation of a <br /> release or threatened release to minimize any potential harm or damage to persons, property, or the environment - <br /> evacuation plans and procedures, including immediate notice, for the site. <br /> CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at <br /> http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br /> This is a (Class 2)Violation. <br /> EHD-CUPA Inspection Report IS02 Page 2 of 3 FA0010836 PR0520516 4525828 7/17/2025 <br /> 1868 E.
