disposal, and regulatory oversight including but not limited to any regulatory fines for the improper storage of <br /> hazardous material. <br /> Pro SE Services, Inc. shall defend and indemnify customer and hold customer harmless from and against any and all <br /> amounts paid in the investigation, derense or settlement of any claims for bodily injury, property damage, <br /> environmental damage, impairment or diminution in value or any other injury or damage caused by Pro SE Services, <br /> Inc.'s conduct in the demolition or disposal. <br /> C) Insurance. <br /> Pro SE Services,Inc.will provide the customer with proof of insurance as applicable to this job. Pro SE Services,Inc. <br /> shall have a policy of Commercial General Liability Insurance with a limit of at least $1 million per occurrence and <br /> annual aggregate covering liability for bodily injury and property damage. Customer shall be named as additional <br /> insured. <br /> D) License. <br /> Pro SE Services is a licensed contractor operating under the following licenses License No. 813309 in the State of <br /> Calirornia and License No. 159941 in the State of Oregon. <br /> E) Ownership Right to Control Site and Materials. <br /> Customer represents that it owns the subject site and/or subject materials.To the extent that customer does not own said <br /> site and/or materials, customer represents and warrants that it has full right to contract Pro SE Services, Inc. for the <br /> demolition or removal of said site and/or materials. Customer will provide, on request from Pro SE Services, Inc., <br /> evidence of said right to demolish and/or dispose of said materials. <br /> E) Waiver of Consequential Damages. <br /> Except far the indemnity provisions of Section IV, each party hereto waives the right to recover from the other <br /> consequential damages arising out of the performance of this work or contract. The only damages that either party will <br /> be liable to the other for,any reason,is property damage or personal injury covered by insurance and the amount of this <br /> contract. Thus, the custorer may not recover from Pro SE Services, Inc. for any reason, any amount in excess of the <br /> amount paid under this contact.
