CONDITIONS OF APPROVAL <br /> PA-2600075 <br /> BEDI-BROTHERS LLC/YADWINDER SINGH <br /> Two-Year Time Extension No. PA-2600075(TE)for previously approved Site Approval Application No. <br /> PA-2200143 (SA) was approved by the Community Development Department on July 30, 2026. This <br /> approval will expire on April 1, 2028,which is five(5)years from the effective date of approval, unless <br /> (1) all Conditions of Approval have been complied with, (2) all necessary building permits-have been- <br /> issued and remain in force, and (3) all necessary permits from other agencies have-been issued and <br /> remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements -pertinent to this <br /> application. Ordinance requirements cannot be modified, and other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT- (Staff Contact: (209)_468-3121) <br /> a. BUILDING GRADING PERMIT: Submit an "APPLICATION-GRADING PERMIT'. The Site Plan <br /> required as a part of the grading building permit must show drainage, driveway access details <br /> including gates, on-site parking, landscaping, signs, existing and proposed utility services, and <br /> grading(refer to the"SITE PLAN CHECKLIST'for details).A fee is required for the Site Plan review. <br /> (Development Title Section 9-802.020) <br /> b. APPROVED USE:This approval is for 2-phased project over 7 years to-fill in and grade a reclaimed <br /> and closed rock quarry with a total fill quantity of approximately 5,538,000 cubic yards of fill dirt for <br /> future agriculture use consistent with the site plan dated June 27, 2022. <br /> c. MITIGATION MONITORING AND REPORTING PROGRAM. The project shall comply with all <br /> required mitigations included in the MMRP dated March 2023. <br /> d. GENERAL REQUIREMENTS: Except as modified by this Section, Chapter 70 of the Uniform <br /> Building Code as adopted by reference by the Board shall govern grading and excavation <br /> operations_ (Development Title Section 9-704.202[c]) <br /> e. WATER OBSTRUCTION: Grading which may obstruct, impede, or-interfere with the natural-flow <br /> of storm waters in such a manner as to cause flooding where it would not otherwise occur, <br /> aggravate any existing flooding condition, or cause accelerated erosion except where said grading <br /> is in accordance with all applicable laws, including but not limited to theses permit requirements. <br /> (Development Title Section 9-704.020[e]) <br /> f. EROSION CONTROL: Protective vegetative planting, silt screen dams, or other approved methods <br /> shall be required where necessary for the control of erosion. <br /> g. WEED CONTROL: If noxious weds are on the site, operations shall be in accordance with <br /> instructions form the Agricultural Commissioner of San Joaquin County. <br /> h. PRIVATE ROADS:All private roads involved in the project shall be maintained so as to control the <br /> creation of dust. <br /> i. AIR QUALITY: All emissions of air pollutants shall be subject to the rules and regulations of the <br /> San Joaquin Valley Unified Air Pollution Control District.
