REGULATION GUIDANCE: 2650(c) Owners or operators must submit a monitoring site plan for approval by the Unified Program Agency. The monitoring site plan must include, but is not limited to, the following: (1) a scaled diagram indicating the layout of the tank(s) and piping to the extent known, including containment sumps. (2) locations of all release detection equipment; and (3) if applicable, each vacuum, pressure, or hydrostatic interstitial monitoring zone. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/and upload a copy of the UST Monitoring Site Plan. Maintain a copy onsite for review. This is a Repeat(Class 2)Violation. 5 23 CCR 16 2613(a)(6) and (b), 2650(a), (d), and (e) 2011013 - Facility has submitted a complete and accurate UST Response Plan OBSERVATION: Owner/Operator failed to submit a complete and accurate UST Response Plan. -The Response Plan on site is current but the Response Plan submitted to CERS does not include emergency contact information or phone numbers for the person(s) responsible in Section IV. REGULATION GUIDANCE: The response plan must be uploaded to the California Environmental Reporting System (CERS). CORRECTIVE ACTION: Immediately log into CERS, upload the completed form, and submit for review by the EHD. This is a (Minor)Violation. 6 23 CCR 16 2613(a)(7), 2690(a)(5); HSC 6.7 25292.2 2011008 - Submitted/maintained current Cert of Financial Responsibility/mech of financial assurance (TCR 11) OBSERVATION: Owner/Operator failed to submit and/or maintain a complete and current Certification of Financial Responsibility or other mechanism of financial assurance. -The Certificate of Financial Responsibility and CFO Letter on site are current (dated 3/10/26) but the documents submitted to CERS are not current. REGULATION GUIDANCE: Current financial responsibility documents are required to be submitted annually. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, and upload the required documents. This is a Repeat(Class 2)Violation. 7 23 CCR 16 2613(a)(8) and (b), 2630(b) 2011004- Owner/Operator submitted DO form within 30 days of UST install or DO change (TCR 10) OBSERVATION: Owner/Operator did not submit the Designated Underground Storage Tank Operator Identification Form to the UPA within 30 days installing UST or changing the DO. -A new designated operator, Kaleb Winkler, began conducting inspections and notification was not provided to the EHD within 30 days of the change. REGULATION GUIDANCE: The owner or operator shall submit a "Designated Underground Storage Tank Operator Identification Form" no later than 30 days after any change in the designated UST operator(s). CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov and upload the notification identifying all the designated operators for this facility.
