Hazelton Avenue
Stockton, CA 95205
Dear Ms. Leal:
The California Department of Transportation appreciates the opportunity to review the
proposed off-premises, pole sign totaling 45 feet in height and a 384 square feet sign
face. The project is located at 800 W. Mossdale Road, Lathrop, southwest of the I-
5/Mossdale Road interchange.
1. For all off-premise commercial advertising displays visible from the National
Highway System, the applicant must apply for an Outdoor Advertising Permit
from the Office of Outdoor Advertising (ODA). The permit application can be
found on this website under Forms: https://dot.ca.gov/programs/traffic-
operations/oda
2. The tree slated for removal/trimming is considered suitable habitat for Migratory
Bird Treaty Act (MBTA). There have been several historical occurrences of
Swainson Hawk within 1.0-mile radius of the project area. In addition, there are
mature trees near Caltrans Right of Way (ROW) that could provide suitable
nesting habitat MTBA. Project activities may impact biological resources within
Caltrans ROW.
3. If work occurs in Caltrans ROW between February 1 and September 30 of any
year, a pre-construction bird survey must be conducted by a qualified biologist
prior to the start of any construction related activities in Caltrans ROW. If an
active nest is observed, a protective buffer must be established around the nest
according to the California Department of Fish and Wildlife (CDFW) guidelines.
No work is allowed within the protective buffer limits until the young have
fledged and until authorized by the Caltrans District 10 Environmental Office.
"Provide a safe and reliable transportation network that serves all people and respects the environment"
