Mr. Robert Fagerness <br /> 11 March 2026 <br /> Page 2 <br /> BACKGROUND <br /> Groundwater monitoring at the Site is conducted under two existing programs that complement <br /> each other: 1) Sitewide Groundwater Monitoring Plan (GWMP3), updated on October 19, 2020, <br /> and 2) the CVRWQCB Waste Discharge Requirement (WDR) for In-Situ Groundwater <br /> Remediation and Discharge of Treated Groundwater to Land Order No. R5-2015-0012-0134 <br /> Monitoring and Reporting Program(WDR-MRP) updated on December 23, 2020, and revised on <br /> 30 May 20225. The GWMP is used to monitor sitewide changes in groundwater elevation and <br /> constituents of concern (COC) concentrations, and the WDR-MRP is intended to evaluate the <br /> performance of the Final Remedy as described in the Remedial Design/Remedial Action(RD/RA) <br /> Work Plan(RAP)6. <br /> Activities at the Site are being conducted as part of the Site Response Plan as defined in the <br /> "Lincoln Center Environmental Remediation Trust Pollution Legal Liability Select Policy" dated <br /> 1 August 1998 and the "Amended First Final Order, Final Judgment and Order Terminating <br /> Permanent Injunction" and supporting Declaration (herein referred to as the Consent Decree) <br /> lodged with the United States District Court, Eastern District of California (the Court) on 15 May <br /> 2001. By definition,the Site Response Plan is a collective group of work plans and remedial action <br /> plans that describe the investigation and the cleanup to be undertaken at the Site. <br /> The Trust is responsible for directing and managing the cleanup of the Site pursuant to the Consent <br /> Decree. The RAP and associated engineering, construction, and administrative activities <br /> conducted by or under the direction of the Trust are covered by an environmental insurance policy. <br /> The insurance policy sunsets on July 1,2030.Consequently,the Trust is implementing remediation <br /> at the Site in a proactive manner with the goal of completing active remediation by 2028 to support <br /> Site closure by the policy sunset date.
