7. No vehicles which contain giant! g� powder,, dynamite, or other explosives <br /> dhall be parked on any County road at nighttime under any conditions nor in the <br /> daytime where the visibility without lights is less than five hundred feet. If <br /> the visibility in the daytime is less 'than five hundred feet, then amber lights <br /> shall be placed in front of and behind said ,parked P vehicle at least at intervals <br /> of one hundred feet for three hundred feet in each direction. <br /> S. All work shall be conducted at the risk and expense of, and all damages, <br /> costs or expense suffered or incurred thereby will be paid by the Permittee, <br /> and 'the Permittee will indemnify and save County free and harmless of and from <br /> any and all liability to or claims of others which may result from or in any <br /> way arise out of or in connection with project operations. <br /> .] p ationa. <br /> -9. The Permittee agrees to furnish a certificate to County indicating that <br /> Permittee has and is maintaining liability insurance insuring against legal <br /> liability for bodily injuries and death, ,and for damages to property in the amount <br /> of $1,000,000.00. The above insurance shall be of the broad form coverage type. <br /> Adequate proof of insurance in compliance with the above requirements shall be <br /> furnished to the Public Works Department 1810 E <br /> f , sat Hazelton Avenue, Stockton, <br /> California 95205. An additional insured endorsement to Permittee's liability <br /> insurance policy naming County, its officers and employees as additional <br /> insureds shall be furnished County. Notwithstanding the above, Permittee's <br /> liability insurance policy shall be endorsed as primary insurance. The <br /> certificate or policy of insurance shall state that COUNTY will be notified at <br /> least thirty (30) days before cancellation of the policy or any material change <br /> thereof. <br /> 10. The Permittee shall not commence work on any roads under the provisions <br /> of this permit until he or she has obtained an encroachment permit to do so from <br /> the Director of Public Works of said County. <br /> 11. Permission shall be obtained by applicant from the owners of fee title <br /> in the form of signed letters of consent from abutting property owners on each <br /> side of all roads, or segments thereof, or a notarized affidavit from the <br /> Permittee attesting that permission has been obtained by Permittee from abutting <br /> property owners on each side of all roads, or segments thereof, authorizing such <br /> geophysical operations, filed by the Permittee with the San Joaquin County <br /> y <br /> Public Works Department prior to the issuance of an encroachment permit. <br /> 12. The Permittee shall work only on those roads shown on the encroachment <br /> permit. <br /> 13. If it is determined by the Director of Public Works that said roads or <br /> underground facilities in the said roads are damaged as a result of the opera— <br /> tions of the Permittee, the Permittee shall pay to the County on demand the cost <br /> of all repairs to all damaged facilities located within the road right of way. <br /> In case of emergency, the County has the right to repair all damaged facilities <br /> 4�7 ._-- 'lmmed.ia-tel. z <br /> y--•s[ -the��exp enae-ofw--thePermittee -;:--; <br /> 14.
