Maintaining a public nuisance, operated contrary to the provisions of the <br />Development Code, in violation of Stockton Municipal Code section 16.224.030; <br />h. Failing to maintain a complete tracking document for the purpose of tracking <br />medical waste from the point when the waste leaves the generator facility until it receives final <br />treatment, in violation of Health and Safety Code section 118040(a); <br />i. Failing to maintain individual medical waste records for a period of three (3) and <br />report or submit to the enforcement agency, in violation of Health and Safety Code section 118165; <br />j. Failing to pay permit fees for an offsite medical waste treatment facility to the <br />Department, in violation of Health and Safety Code section 118210(a); <br />k. Failing to bag and place for storage, handle or transport biohazardous waste in a <br />rigid container that is leak resistant with tight-fitting covers, kept clean and in good repair and <br />labeled with the words "Biohazardous Waste" or the international biohazard symbol and the word <br />"Biohazard", in violation of Health and Safety Code section 118280(c); <br />1. Storing biohazardous waste above 0 Centigrade (32 Fahrenheit) at a location or <br />facility that is offsite from the generator for more than seven (7) days before treatment, in violation <br />of Health and Safety Code section 118280(e)(4); <br />m. Failing to provide an enclosure or designated accumulation area to protect medical <br />waste from animals and natural elements and not provide a breeding place or a food source for <br />insects and rodents, in violation of Health and Safety Code section 118310; <br />n. Intentionally making false statements or representations in an application, label, <br />tracking document, record, report, permit, registration, or other document filed, maintained, or used <br />for the purpose of compliance, in violation of Health and Safety Code section 118345(a); <br />o. Failing to take all reasonable steps to minimize or correct any adverse impact on <br />the environment resulting from noncompliance with the conditions of the permit, in violation of <br />California Code of Regulations, title 22 section 65623(d); and <br />p. Failing to report any noncompliance with the Medical Waste Management Act, <br />orally within twenty-four (24) hours and in a written report within five (5) days of the time the <br />-4- <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
