I operator and to each Designated Operator of each Current Facility and provide a list of names and <br /> 2 addresses to whom the notification was sent. This communication shall be delivered by Chevron <br /> 3 to a new owner or operator following any subsequent change in the ownership or operation of any <br /> 4 Current Facility, and a copy of the notification sent to Plaintiff as provided in Paragraph 16. <br /> 5 FINANCIAL OBLIGATIONS <br /> 6 8. Defendants Chevron U.S.A. Inc, and Chevron Stations Inc.,jointly and severally, shall <br /> 7 pay or expend a total of TWENTY FOUR MILLION, FIVE HUNDRED THOUSAND <br /> S DOLLARS ($24,500,000.00) for the financial settlement obligations due pursuant to this <br /> 9 Stipulation and the Final Judgment entered in this action. The settlement payments and <br /> 10 expenditures shall be allocated as set forth in the following paragraphs, and as further specified in <br /> I I the supporting exhibits, attached hereto and incorporated by this reference. Financial obligations <br /> 12 set forth in this Stipulation and the Final Judgment entered in this action do not affect, interfere <br /> 13 with, or prejudice any other financial obligations Defendants have pursuant to any other statutory, <br /> 14 judicial or administrative proceeding. <br /> 15 CIVIL PENALTIES <br /> 16 9, Defendants Chevron U.S.A. Inc. and Chevron Stations Inc.,jointly and severally, shall <br /> 17 pay SIXTEEN MILLION DOLLARS ($16,000,000.00) to Plaintiff as civil penalties, as <br /> 18 follows: <br /> 19 (a) TWO MILLION DOLLARS($2,000,000.00) as civil penalties to the California <br /> 20 State Water Resources Control Board for alleged violations of Chapter 6.7 of Division 20 of the <br /> 21 California Health and Safety Code,made payable to the "State Water Pollution Cleanup and <br /> 22 Abatement Account"within thirty (30) days from the Effective Date of the Final Judgment <br /> 23 entered in this action. These funds may be used by the State Water Resources Control Board, at <br /> 24 its discretion, to fund activities associated with the investigation and/or enforcement of <br /> 25 underground storage tank requirements, including those codified at Chapter 6.7 of the California <br /> 26 Health and Safety Code and its implementing regulations, and the investigation and/or protection <br /> 27 of the Underground Storage Tank Cleanup Fund. These activities may include, but are not <br /> 28 <br /> .6 <br /> Stipulation for Entry of Fina] Judgment and Permanent Injunction <br />
