Violation of H&S Code §25189.5(b); <br />b. Violation of H&S Code §25189.5(d). <br />4. Defendants with actual or constructive knowledge of this injunction, only in so far as they are doin, <br />business in the State of California, in the course of defendant's TOTAL CHEMICAL NEEDS activities, are <br />pursuant to Health and Safety Code §25500 et seq. hereby permanently enjoined from: <br />a. Violation of Health and Safety Code §25504(c); <br />b. Violation of Health and Safety Code §25503.5; <br />c. Violation of Health and Safety Code §25504(b). <br />5. Defendants with actual or constructive knowledge of this injunction, only in so far as they are <br />doing business in the State of California, in the course of defendant's TOTAL CHEMICAL NEEDS <br />activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />a. Violation of Health and Safety Code §25100 et seq., as described in paragraph 3 - 3b <br />above; <br />b. Violation of Health and Safety Code §25500 et seq., as described in paragraph 4 - 4c <br />above; <br />c. Violation of the California Fire Code, Article 79, as it relates to hazardous waste and <br />hazardous materials; <br />d. Violation of the California Fire Code, Article 80, as it relates to hazardous waste and <br />hazardous materials. <br />6. Defendant shall pay to plaintiff the sum of NINETEEN THOUSAND EIGHT HUNDRED <br />SEVENTY-FIVE DOLLARS ($19,875.00), as and for civil penalties, pursuant to Business and Professions <br />Code §17200 et seq.. Said payments shall be made payable to the TREASURER OF SAN JOAQUIN <br />COUNTY and delivered to the San Joaquin County Office of the District Attorney, Environmental <br />Prosecutions Unit, by the following dates: <br />$6,625.00, on or before July 1, 2008 <br />$6,625.00, on or before July 1, 2009 <br />2. <br />
