Said payment shall be due and na able to the aforementioned <br />agency, and shall be delivered to the San Joaquin County Office of the District Attorney, Environmental <br />Prosecutions Unit, on or before July 1, 2007. <br />9. Defendant shall be penalized, as and for civil penalties, pursuant to Business and Professions <br />Code § 17200, in addition to those penalties set forth in paragraphs 6 - 8, SEVENTY-FIVE THOUSAND <br />DOLLARS ($75,000.00). However, it is stipulated by all parties that the entire additional SEVENTY- <br />FIVE THOUSAND DOLLARS ($75,000.00), in civil penalties shall be stayed for a period of three years <br />from the date of signing this document, on the condition that the defendant not violate the conditions set <br />fourth in paragraph 3 - 5d. <br />10. The SEVENTY-FIVE THOUSAND DOLLARS ($75,000.00), described in paragraph 9 above, <br />shall immediately be due if the San Joaquin County District Attorney files declarations that defendant <br />violated any of the provisions of paragraph 3 - 5d. <br />11. Defendant shall additionally pay to plaintiff the sum of TWO THOUSAND TWO HUNDRED <br />SEVENTY-EIGHT DOLLARS ($2,278.00) as partial recovery of the cost of investigation and suit incurrej <br />by the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall <br />be due and payable to the aforementioned agency, and shall be delivered to the San Joaquin County Office <br />of the District Attorney, Environmental Prosecutions Unit, at time of signing. <br />12. Defendant shall additionally pay to plaintiff the sum of NINE HUNDRED EIGHTY-NINE <br />DOLLARS ($989.00) as partial recovery of the cost of investigation and suit incurred by the SAN <br />JOAQUIN COUNTY OFFICE OF EMERGENCY SERVICES. Said payment shall be due and payable to <br />the aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br />Attorney, Environmental Prosecutions Unit, at time of signing. <br />13. Defendant shall additionally pay to plaintiff the sum of TWO THOUSAND SIX HUNDRED <br />TWENTY-FIVE DOLLARS ($2,625.00) as partial recovery of the cost of investigation and suit incurred <br />by the CITY OF STOCKTON FIRE DEPARTMENT. Said payment shall be due and payable to the <br />aforementioned agency, and shall be delivered to the San Joaquin County Office of the District Attorney, <br />Environmental Prosecutions Unit, at time of signing. <br />4. <br />
