1 which constitutes an unfair and/or unlawful business practice. <br /> 2 13. The use of such unlawful and or unfair business practices constitutes unfair <br /> 3 competition within the meaning of section 17200 et seq. of the Business and Professions Code. The <br /> 4 unlawful and/or unfair business practices committed by the defendants include, but are not limited to: <br /> 5 a. Violation of California Fire Code, Article 80, section 8004, failed to obtain a <br /> 6 Hazardous Materials permit; <br /> 7 b. Violation of California Fire Code, Article 49, failed to obtain a Hot-Works <br /> 8 Operation permit; <br /> 9 C. Violation of California Fire Code, Article 79, sections 7402 and 7403, failed <br /> 10 to obtain a Compressed Gas permit; <br /> 11 d. Violation of California Fire Code, Article 79, sections 7902 and 7903, failed <br /> 12 to obtain a Flammable and Combustible Liquid Storage and Handling permit; <br /> 13 e. Violation of California Fire Code, Article 80, section 8001.11.8, failed to <br /> 14 separate incompatible materials; <br /> 15 f. Violation of California Fire Code, Article 80, section 8001.7, failed to provide <br /> 16 visible hazard identification signs or conspicuously mark or label containers; <br /> 17 g. Violation of California Fire Code, Article 79, section 7902.1.6, failed to <br /> 18 separate incompatible hazardous materials from flammable and combustible liquids, and failed to <br /> 19 accumulate waste Class I, II and II-A liquids in a safe manner at a storage site; <br /> 20 h. Violation of California Fire Code, Article 80, section 8003.3.1.2, failure to <br /> 21 provide internally sprinklered gas cabinets, exhausted enclosure and gas rooms for the storage of <br /> 22 cylinders; <br /> 23 i. Violation of California Fire Code, Article 80, section 8003.3.1.3.1, failure to <br /> 24 store portable and stationary tanks within gas rooms or exhausted enclosures; the room or area in <br /> 25 which gas cabinets or exhausted enclosures are located shall be provided with exhausted ventilation; <br /> 26 j. Violation of California Fire Code, Article 80, section 8003.3.1.3.5, failure to <br /> 27 utilize the treatment system to handle the accidental release of gas and process all exhaust ventilation <br /> 28 to be discharged from the gas room; <br /> Complaint for Injunction,Civil Penalties and Other Relief Page 6 <br />
