Costs: Sierra Chemical has spent considerable money to maintain the <br />containment and prevent discharge of acid to the environment. <br />The original concrete containment was replaced. $ 7,902.00 <br />Removal and reinstallation of equipment. $10,000.00 <br />Coating of concrete. $ 5,000.00 <br />Estimate of cost to recoat the containment. $ 4,475.00 <br />Training on Used Oil Management $ 1,000.00 <br />Removal Cost Shop Hazards Solutions $ 273.49 <br />Complaint: <br />b. Failed to determine if a waste is a hazardous waste, in violation of California <br />Code of Regulations, Title 22, section 66262.11. <br />Environmental Health Department: <br />In the warehouse, an open container of an unknown material was stored with no <br />determination of its contents. This is a violation of CCR, Title 22, Section <br />66262.11. <br />In the hazardous waste storage area, several drums of material had no waste <br />determination made. This is a violation of CCR, Title 22, Section 66262.11. <br />Sierra Chemical Response and Action: <br />The open container in the warehouse was identified closed and labeled. Ms. <br />Foley was informed by letter dated August 30, 2005. She questioned how the <br />determination was made. This was explained by letter dated October 17, 2005. <br />The drums in the hazardous waste storage area were sampled by Universal <br />Environmental and Philips Services to determine the hazardous class. The <br />material was removed from the facility by 21 �` Century EMI on September 29, <br />2005. A copy of the Uniform Hazardous Waste Manifest was provided to the <br />Department of Toxic Substances Control. <br />Costs: <br />Universal Environmental Sampling. $ 2,472.25 <br />Philips Service / 21' Century sampling and removal. $ 3,339.20 <br />Sierra Chemical in house testing and response. $ 1,000.00 <br />Complaint: <br />C. Facility not maintained to minimize the release of a hazardous waste, in violation <br />of California Code of Federal Regulations, Title 22, section 66265.31 <br />Environmental Health Department: <br />In the Warehouse, broken bags of acid were left open on pallets, also an <br />aboveground tank of caustic was leaking and next to this tank was evidence of <br />concrete deterioration. One black 55 gallon drum appeared to be compromised <br />
