hazardous material, including, but not limited to, familiarity with the plans and <br />procedures specified in Health and Safety Code section 25504(b). <br />Sierra Chemical Response and Action: <br />Newly hired employees are trained on our Accident Prevention Plan, Emergency <br />Response Plan (now Emergency Action Plan), Spill Response Plan, and Personal <br />Protective Equipment. All of these programs cover safety procedures in the event <br />of a release or threatened release of a hazardous material. <br />Following the inspection our Emergency Response Plan was revised into an <br />Emergency Action Plan. Training has taken place on the revised plan. <br />The training records requested at the time of the inspection were not all located at <br />the Stockton Facility. They were submitted to Dennis Fields from our Sparks, <br />Nevada Corporate Office by transmittal letter dated August 8, 2005. <br />Complaint: <br />d. Violation of Health and Safety Code section 25505, failed to submit a business <br />plan for emergency response to a release or threatened release of hazardous <br />material within four (4) years prior to filing of this complaint for 1010 <br />INDUSTRIAL DRIVE, STOCKTON, CALIFORNIA, to the San Joaquin County <br />of Emergency Services. Further, it is alleged that said violation was knowingly <br />committed after reasonable notice. <br />Sierra Chemical Response and Action: <br />A Business Plan (FEVEVIP) has been in force continually since the facility was <br />established It has been updated annually and certified as required. <br />The 2002 IDvEMP Certification Statement was submitted 12/18/2001 <br />The 2003 EACAP Certification Statement was recorded 1/13/2003 <br />The 2004 HMMP Certification Statement was recorded 1/23/2004 <br />The 2005 HXVvIP Certification Statement was recorded 1/17/2005 <br />The 2005 HMMP was revised 10/10/2005 <br />The 2006 HAEVIP Certification was recorded 1/17/2006 <br />Each year all required changes to the inventory or staffing have been made. <br />Sierra Chemical also has maintained an Emergency Response Plan that covered <br />response to all emergencies. Following the July 28, 2005 inspection a policy <br />decision was made to revise our emergency response policy. The revised policy <br />consists of only notification as per the California Hazardous Material <br />Spill/Release Notification Guidance and support by Technician Level Trained <br />Personnel to the Local Fire Department. <br />
