The following is an itemized list of hazardous materials violations that have not been <br /> addressed for SOUTHERN WINE & SPIRITS as of April 26, 2016. <br /> Open violations from December 08, 2015 inspection <br /> Violation#1 -Failed to establish and implement a hazardous materials business plan. <br /> A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business <br /> Plan shall be established and implemented for emergency response to a release or threatened release of a hazardoi <br /> material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are <br /> liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the <br /> required information, and submit for review by the EHD. <br /> Violation #2 - Failed to electronically submit a business plan. <br /> The facility's business plan was not submitted electronically to the California Environmental Reporting System (CER: <br /> for the years 2013, 2014 and 2015. As of January 1, 2013, all businesses were required to submit all business plans <br /> electronically. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, <br /> and submit to the EHD for approval. <br /> Violation#3 - Failed to annually review and certify that the business plan is complete, accurate, and up to <br /> date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS)for the years 2013, 2014 and 2015. The hazardous materials inventory shall be submitted by Janua <br /> 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the <br /> CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> Violation#6 -Failed to complete and/or submit the Business Activities or Owner/Operator Identification <br /> page. <br /> The Business Activities and the Business Owner/Operator Identification forms have not been submitted for the years <br /> 2013, 2014 and 2015. This information must be current and submitted as part of the business plan. Immediately lo, <br /> into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or update( <br /> information, and submit to the EHD for approval. <br /> Violation#10 -Failed to complete and/or submit a site map with all required content. <br /> A site map has not been submitted for the years 2013, 2014 and 2015. A site map shall contain a north orientation, <br /> loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, emergency shutoffs, <br /> evacuation staging areas, hazardous material handling and storage areas, and emergency response equipment. <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Violation #11 - Failed to establish and/or submit emergency response procedures for a release or <br /> threatened release. <br /> The emergency response procedures have not been submitted for the years 2013, 2014 and 2015. A business plan <br /> shall include the following emergency response procedures for a release or threatened release of hazardous materia <br /> including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Page 1 of 2 <br />
