EXHIBIT E - CHEVRON UST COMPLIANCE ASSURANCE INITIATIVES <br /> Chevron has developed a set of Underground Storage Tank ("UST") Compliance <br /> Assurance Initiatives ("Initiatives") to help meet its goal of achieving full compliance with <br /> California's UST regulations at all of its service stations in the State of California ("Stations"). <br /> This includes both its company-owned, company-operated Stations ("COCOs") and its <br /> company-owned, retail-operated Stations ("COROs"). These Initiatives are intended to improve <br /> upon the UST compliance management practices that Chevron already has in place. <br /> Nothing in this document shall be interpreted or applied to relieve Defendants of their <br /> existing obligations to comply with statutes, regulations, requirements, or other laws. Nothing in <br /> this document shall be interpreted as an admission of wrongdoing or liability by Chevron. <br /> In the event that Chevron undergoes organizational or management changes that affect its <br /> future administration and implementation of any of the Initiatives described herein, Chevron <br /> shall contact the Attorney General's office to notify it of the change. In addition, Chevron shall <br /> provide the Attorney General with a description of the change, how Chevron will continue <br /> effective administration and implementation of the Initiative, and a reasonable opportunity to <br /> suggest any revision to the Initiative that may be necessitated by the change. <br /> The Initiatives shall include the following: <br /> A. Centralized Management Responsibility <br /> Chevron shall consolidate the activities related to UST compliance certification testing <br /> and maintenance within a single organization (Maintenance and Construction) in order to <br /> improve coordination and increase accountability. <br /> Chevron shall monitor the success of the Initiatives described in this document by <br /> annually reviewing the performance of both employees and third-party contractors. Chevron <br /> shall develop and impose strict consequences for non-compliance with UST regulations by <br /> imposing performance requirements for employees, which will be tied to such employees' <br /> reviews and job promotion as further described in sub-part (D), and enforcing contractual <br /> obligations for third-party contractors, as further described in sub-part (F). <br /> B. New Compliance Coordinator Positions <br /> Chevron shall create at least two new compliance coordinator positions within its <br /> Maintenance and Construction organization. These coordinators will serve as a centralized <br /> resource for all communication and activity related to the certification, testing, and associated <br /> maintenance of the UST systems at each Station. The coordinators shall be assigned to one of <br /> two geographic zones (Northern California and Southern California) and be responsible for all <br /> Stations within their assigned zone. In addition, the coordinators will communicate with <br /> Certified Unified Program Agencies ("CUPAs") regarding the correction of any issues identified <br /> during Station compliance testing and certification("Notice"). <br /> The coordinators will utilize Chevron's improved database system, described below, to <br /> track and monitor UST compliance throughout the State. <br /> EXHIBIT E to Final Judgment in People v.
