C. Independent Health, Environment and Safety Oversight <br /> Chevron shall use its Health, Environment and Safety ("HES") organization and <br /> personnel to provide several key functions rdlated to improved UST compliance, including <br /> offering subject matter expertise regarding UST system compliance issues at individual Stations, <br /> and, if the HES service station representative deems it necessary, providing internal oversight of <br /> UST compliance at each Station. <br /> D. Station Level Compliance <br /> Chevron shall develop and maintain (and conduct training relating to) clear job <br /> responsibilities and ongoing, periodic reporting obligations for all Chevron employees <br /> responsible for UST compliance at the Station level, including business consultants, compliance <br /> coordinators, site managers, and designated operators. Job success and advancement shall be <br /> tied to the performance of an employee's UST compliance responsibilities. <br /> E. Monitoring Equipment Verification <br /> Chevron shall inspect all of the sensors used to monitor the UST secondary containment <br /> systems at every Station within 90 days of the date of the Effective Date of the Final Judgment. <br /> This inspection shall verify that the monitoring equipment and systems are in proper working <br /> order and that the sensors are properly placed at a low point within the sump. Chevron will keep <br /> written records of this verification and maintain such records in a database. <br /> Chevron shall seek to ensure that sensors and site monitoring systems are not tampered <br /> with. Access to such sensors and systems shall be limited to authorized personnel, including <br /> Chevron station managers, construction and maintenance employees, and HES station <br /> representatives. Chevron shall discipline any Station employee or third-party contractor who <br /> tampers or attempts to tamper with the sensors or monitoring systems. <br /> Chevron shall develop a program to visually inspect the secondary containment systems <br /> at each of its Stations for the presence of liquid at least once every 120 days. Any liquid found <br /> during such inspections will be promptly removed and the cause of the liquid intrusion will be <br /> investigated and addressed. <br /> F. Monitoring of Third-Party Contractors <br /> Chevron relies on third-party contractors to aid in the monitoring, compliance testing and <br /> certification, and maintenance of its UST systems. Each year, Chevron shall conduct a <br /> performance review of such third-party contractors to ensure compliance with all applicable rules <br /> and regulations. Chevron shall notify third-party contractors of the consequences of non- <br /> compliance, which may include, but are not limited to, termination of the third-party's contract <br /> with Chevron. <br /> Chevron shall not allow the sub-contracting of UST maintenance and construction <br /> operations to contractors that have not been approved by Chevron. <br /> Exhibit E to Final Judgment in People v.
