Violating Health and Safety Code §25503.5(a), being a "d H '"uuuN v u> #l �ssrthd`44�Yc�fAazardous 2 material or a mixture containing a hazardous material that has a quantity at any one time during the reportin 3 year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or 200 cubic feet 4 at standard temperature and pressure for compressed gas, including but not limited to ACETYLENE, 5 ANTIFREEZE, DIESEL, MOTOR OIL, OXYGEN„PROPANE, WASTE MOTOR OIL, and failing to 6 establish and implement a business plan for emergency response to a release or threatened release of a 7 hazardous material; S b. Violating Health and Safety Code §25504(b),business plan fails to include emergency 9 response plans and procedures in the event of a reportable release or threatened release of a hazardous 10 material, including but not limited to the following: 11 1 1. Immediate notification to the San Joaquin County Office of Emergency Services 12 and to the appropriate local emergency rescue personnel; 13 2. Procedures for the mitigation of a release or threatened release to minimize any 14 potential harm or damage to persons, property, or the environment; 15 3. Evacuation plans and procedures, including immediate notice, for the business 16 site; 17 c. Violating Health and Safety Code §25504(c), being a business that fails to train all new IS employees and provide annual training, including refresher courses, for all employees in safety procedures i 19 the event of a release or threatened release of a hazardous material, including,but not limited to, familiarity 20 with the plans and procedures specified in Health and Safety Code §25504(b)• 21 d. Violating Health and Safety Code §25505(a)(1), being a business that fails to submit a 22 business plan for emergency response to a release or threatened release of hazardous material in accordance 23 with the requirements of Health and Safety Code Chapter 6.95, Article 1; 24 e. Violating Health and Safety Code §25505(e)(2),being a business that fails to annually 25 submit a form, provided by the San Joaquin County Office of Emergency Services, that certifies that the 26 handler has included, and maintains as current, in the business plan, all other information required by Health 27 and Safety §25504. 28 4.
