Violating Health and Safety Code §25503.5(a), being a "d H '"uuuN v <br /> u> #l �ssrthd`44�Yc�fAazardous <br /> 2 material or a mixture containing a hazardous material that has a quantity at any one time during the reportin <br /> 3 year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or 200 cubic feet <br /> 4 at standard temperature and pressure for compressed gas, including but not limited to ACETYLENE, <br /> 5 ANTIFREEZE, DIESEL, MOTOR OIL, OXYGEN„PROPANE, WASTE MOTOR OIL, and failing to <br /> 6 establish and implement a business plan for emergency response to a release or threatened release of a <br /> 7 hazardous material; <br /> S b. Violating Health and Safety Code §25504(b),business plan fails to include emergency <br /> 9 response plans and procedures in the event of a reportable release or threatened release of a hazardous <br /> 10 material, including but not limited to the following: <br /> 11 1 1. Immediate notification to the San Joaquin County Office of Emergency Services <br /> 12 and to the appropriate local emergency rescue personnel; <br /> 13 2. Procedures for the mitigation of a release or threatened release to minimize any <br /> 14 potential harm or damage to persons, property, or the environment; <br /> 15 3. Evacuation plans and procedures, including immediate notice, for the business <br /> 16 site; <br /> 17 c. Violating Health and Safety Code §25504(c), being a business that fails to train all new <br /> IS employees and provide annual training, including refresher courses, for all employees in safety procedures i <br /> 19 the event of a release or threatened release of a hazardous material, including,but not limited to, familiarity <br /> 20 with the plans and procedures specified in Health and Safety Code §25504(b)• <br /> 21 d. Violating Health and Safety Code §25505(a)(1), being a business that fails to submit a <br /> 22 business plan for emergency response to a release or threatened release of hazardous material in accordance <br /> 23 with the requirements of Health and Safety Code Chapter 6.95, Article 1; <br /> 24 e. Violating Health and Safety Code §25505(e)(2),being a business that fails to annually <br /> 25 submit a form, provided by the San Joaquin County Office of Emergency Services, that certifies that the <br /> 26 handler has included, and maintains as current, in the business plan, all other information required by Health <br /> 27 and Safety §25504. <br /> 28 4.
