F � • <br /> 1 business in the State of California, in the course of Defendant's OPERATING AN AIRPORT activities, is <br /> 2 pursuant to Health and Safety Code §25516 hereby permanently enjoined from: <br /> 3 a. Violating Health and Safety Code §25503.5(a), being a business that handles a <br /> 4 hazardous material or a mixture containing a hazardous material that has a quantity at any one time during <br /> 5 the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, <br /> 6 or 200 cubic feet at standard temperature and pressure for compressed gas, including but not limited to <br /> 7 GASOLINE, and failing to establish and implement a business plan for emergency response to a release or <br /> 8 threatened release of a hazardous material; <br /> 9 b. Violating Health and Safety Code §25504(b), business plan fails to include emergency <br /> 10 response plans and procedures in the event of a reportable release or threatened release of a hazardous <br /> 11 material, including but not limited to the following: <br /> 12 1. Immediate notification to the San Joaquin County Office of Emergency Services <br /> 13 and to the appropriate local emergency rescue personnel; <br /> 14 2. Procedures for the mitigation of a release or threatened release to minimize any <br /> 15 potential harm or damage to persons, property, or the environment; <br /> 16 3. Evacuation plans and procedures, including immediate notice, for the business <br /> 17 site; <br /> 18 c. Violating Health and Safety Code §25504(c) being a business that fails to train all new <br /> 19 employees and provide annual training, including refresher courses, for all employees in safety procedures <br /> 20 in the event of a release or threatened release of a hazardous material, including, but not limited to, <br /> 21 familiarity with the plans and procedures specified in Health and Safety Code §25504(b); <br /> 22 d. Violating Health and Safety Code §25505(a)(1), being a business that fails to submit a <br /> 23 business plan for emergency response to a release or threatened release of hazardous material in accordance <br /> 24 with the requirements of Health and Safety Code Chapter 6.95, Article 1; <br /> 25 e. Violating Health and Safety Code §25505(e)(2), being a business that fails to annually <br /> 26 submit a form, provided by the San Joaquin County Office of Emergency Services, that certifies that the <br /> 27 handler has included, and maintains as current, in the business plan, all other information required by <br /> 28 Health and Safety §25504. <br /> 2. <br />
