Defendant with actual or constructive knowledge of this injunction, only in so far as it is doing <br /> 2 business in the State of California, in the course of Defendant's OPERATING AN AIRPORT activities, <br /> 3 are pursuant to Business and Professions Code §17203 hereby permanently enjoined from: <br /> 4 a. Violating Chapter 6.95 of the Health and Safety Code as described in paragraph 3 - 3e <br /> 5 above. <br /> 6 5. Defendant shall be penalized FIVE THOUSAND DOLLARS ($5,000.00), as and for civil <br /> 7 penalties,pursuant to Business and Professions Code sections 17200 et seq. However, it is stipulated by <br /> 8 all parties that the entire FIVE THOUSAND DOLLARS ($5,000.00), in civil penalties shall be stayed for <br /> 9 five (5)years on the condition that the following terms are met: <br /> 10 a. On or before January 15, 2008, Defendant shall file with the San Joaquin County Office <br /> 11 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 12 year 2008; <br /> 13 b. On or before January 15, 2009, Defendant shall file with the San Joaquin County Office <br /> 14 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 15 year 2009; <br /> 16 c. On or before January 15, 2010, Defendant shall file with the San Joaquin County Office <br /> 17 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 18 year 2010. <br /> 19 d. On or before January 15, 2011, Defendant shall file with the San Joaquin County Office <br /> 20 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 21 year 2011. <br /> 22 e. On or before January 15, 2012, Defendant shall file with the San Joaquin County Office <br /> 23 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 24 year 2012. <br /> 25 f. Defendant will not violate Health and Safety Code §25516 as described in paragraph 3 - <br /> 26 3e above; <br /> 27 g. Defendant will not violate Business and Professions Code §17203 as described in <br /> 28 paragraph 4 - 4a above. <br /> 3. <br />
