The FIVE THOUSAND DOLLARS ($5,000.00), described in paragraph 8 above, shall <br /> 3 immediately be due and payable if the San Joaquin County District Attorney files declarations that <br /> 4 Defendant violated Health and Safety Code §25516 or Business and Professions Code §17203, as <br /> 5 described in paragraphs 3 and 4 above. <br /> 6 10. If all the conditions listed in paragraph 8 above are met, then five (5) years from the filing date <br /> 7 of this document, the stayed penalty shall be suspended permanently. <br /> 8 11. Defendant shall pay to plaintiff the sum of FOUR HUNDRED DOLLARS ($400.00), for <br /> 9 partial cost of investigation incurred by the San Joaquin County Office of Emergency Services. Said <br /> 10 payments shall be made payable to the SAN JOAQUIN COUNTY OFFICE OF EMERGENCY <br /> 11 SERVICES and delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 12 Prosecutions Unit, on or before September 3, 2007. <br /> 13 12. Defendant shall additionally pay to plaintiff the sum of SEVEN HUNDRED DOLLARS <br /> 14 ($700.00), for partial cost of investigation and suit incurred by the San Joaquin County Office of the <br /> 15 District Attorney. Said payment shall be due and payable to and delivered to the SAN JOAQUIN <br /> 16 COUNTY OFFICE OF THE DISTRICT ATTORNEY, ENVIRONMENTAL PROSECURIONS UNIT, <br /> 17 on or before September 3, 2007. <br /> 18 13. This judgment shall go into effect immediately upon entry hereof.
