The FIVE THOUSAND DOLLARS ($5,000.00), described in paragraph 5 above, shall <br /> 2 immediately be due and payable if the San Joaquin County District Attorney files declarations that <br /> 3 defendants violated Health and Safety Code §25516 or Business and Professions Code §17203, as <br /> 4 described in paragraphs 3 and 4 above. <br /> 5 7. If all the conditions listed in paragraph 5 above are met, then five(5) years from the filing date <br /> 6 of this document, the stayed penalty shall be suspended permanently. <br /> 7 8. Defendant shall be penalized FIVE THOUSAND DOLLARS ($5,000.00), as and for civil <br /> 8 penalties,pursuant to Health & Safety Code §§25514 and 25515.2. However, it is stipulated by all parties <br /> 9 that the entire FIVE THOUSAND DOLLARS ($5,000.00), in civil penalties shall be stayed for five (5) <br /> 10 years on the condition that the following terms are met: <br /> 11 a. On or before January 15, 2008, Defendant shall file with the San Joaquin County Office <br /> 12 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 13 year 2008; <br /> 14 b. On or before January 15, 2009, Defendant shall file with the San Joaquin County Office <br /> 15 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 16 year 2009; <br /> 17 c. On or before January 15, 2010, Defendant shall file with the San Joaquin County Office <br /> 18 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 19 year 2010. <br /> 20 d. On or before January 15, 2011, Defendant shall file with the San Joaquin County Office <br /> 21 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 22 year 2011. <br /> 23 e. On or before January 15, 2012, Defendant shall file with the San Joaquin County Office <br /> 24 of Emergency Services the Hazardous Material Management Plan and Employee Training Records for the <br /> 25 year 2012. <br /> 26 f. Defendant will not violate Health and Safety Code §25516 as described in paragraph 3 - <br /> 27 3e above; <br /> 28 g. Defendant will not violate Business and Professions Code §17203 as described in <br /> 4. <br />
