No integrity testing has been conducted for the four diesel tanks,and the 55 gallon drum of waste diesel. Inspections and testing shall be conducted on all aboveground liquid petroleum containers larger than 55 gallons, and all 55 gallon drums of oil. Records of these inspections and tests shall be signed by the appropriate supervisor or inspector and kept on site with the Spill Prevention, Control,and Countermeasure(SPCC)Plan for a period of three years. Immediately begin necessary testing and inspections for all Aboveground Petroleum Storage Act regulated containers and maintain on site with the SPCC Plan. This is a repeat violation,Class II. 714 CFR 112.8(c)(8)(i-iv)Failed to provide each container with a high level monitoring device. 1)There was no high liquid monitoring device on the 55 gallon drum of waste diesel. 2)Diesel tank 3 was observed with a high liquid level sensing device with a small vision gauge facing away from the fill pipe.This vision gauge could not be seen or monitored from the fill pipe. At least one of the following devices must be installed in each container: -High liquid level alarm with audible or visual signal -High liquid level pump cutoff device set to stop flow at a predetermined content level -Direct audible or code signal communication between the container gauger and the pumping station -Fast response system,such as digital computer,telepulse, or direct vision gauge. If a direct vision gauge is being used for determining the liquid level of each tank, a person must be present to monitor gauges and the overall filling of the tanks. Immediately install an approved liquid level sensing device in accordance with CFR 112.8 and implement necessary procedures to ensure that the devices are fully functional and in use at all times during tank filling operations, or provide equivalence as allowed by CFR 112.7(a)(2). This is a Class It violation. 715 CFR 112.8(c)(8)(v)Failed to regularly test liquid level sensing devices to ensure proper operation. Liquid level sensing devices have not been tested for diesel tank 3. Procedures and frequency of testing for these devices were not addressed in the Spill Prevention, Control, and Countermeasure(SPCC)plan. Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be regularly tested to ensure proper operation. Immediately conduct all necessary testing of liquid level sensing devices, or provide equivalence as allowed by CFR 112.7(a)(2). This is a repeat violation,Class Il. 717 CFR 112.8(c)(10)Failed to promptly correct visible discharges and/or remove accumulations of oil in diked areas. An active leak of oily liquid was observed at the diesel fill pipe,and at the diesel fill motor.There was visible staining around the diesel fill pipe, and the diesel fill motor.Also,there was a bucket filled with oily liquid at the motor closest to tank 4.According to Dayal Dess(worker),the bucket was placed there because the piping sometimes leaks. Visible discharges which result in a loss of oil from a container, including but not limited to seams,gaskets, piping, pumps,valves, rivets,and bolts, must be promptly Corrected. Immediately fix the leak,clean the pooled discharge, and manage according to the California Code of Regulations Title 22 hazardous waste regulations. This is a repeat violation, Class II.
