Failed to prepare a written SPCC Plan in accordance with CFR § 112. Each owner/ operator shall <br /> prepare a spill prevention control and countermeasure plan and conduct periodic inspection of the storage <br /> tank to assure compliance with CFR § 112. Correct by preparing a SPCC plan that is fully certified by a <br /> Professional Engineer. Submit a copy of only the page that contains the information that the plan is reviewed <br /> and fully certified by a Professional Engineer. Certification must comply with CFR § 112.3(e). <br /> #7. Failed to retain a copy of the SPCC Plan on-site. A complete copy must be maintained onsite at the <br /> facility for review upon request by an inspector. Correct by maintaining a SPCC Plan certified by <br /> Professional Engineer on-site. <br /> #52. Failed to promptly correct visible discharges and remove accumulation of oil from container. In the <br /> secondary containment/ cement berm of the diesel and gasoline tanks, there is a large accumulation of <br /> rainwater, a small oil sheen and growth of algae. Correct by promptly removing the accumulation from the <br /> secondary containment. Remove the oil sheen from the accumulation and dispose of properly according to <br /> California Code of Regulation, Title 22, Hazardous Waste Regulations. Maintain good housekeeping around <br /> the tanks so that leaks and damages can be easily found. <br /> #57. Failed to regularly inspect aboveground valves, piping and appurtenances. There is dark diesel staining <br /> on the piping connecting to the fuel dispenser. It is difficult to determine if there are piping beneath the <br /> accumulation of rainwater and growth of algae. During inspection, assess the conditions of flange joints, <br /> expansion joints, valve glands and bodies, catch pans, pipeline support, locking of valves and metal <br /> surfaces. Correct by regularly inspecting aboveground valves, piping and appurtenance to be able to detect <br /> leaks or damages. <br /> Submit to SJC EHD within 30 days (07-04-10)- <br /> 1. <br /> 07-04-10):1. one copy of the completed `Return to Compliance Certification' <br /> 2. a corrective action statement for above violations <br /> Notes: <br /> 1. Diesel tank has a high liquid level pump cutoff device that is set to stop flow at a predetermined <br /> container content level: shut off valve. <br /> 2. Inventory product are recorded by drivers who receives fuel, a inventory measuring stick on the tank <br /> and the metered fuel dispenser. <br /> 3. Vehicles entering fuel station would unlikely not endanger oil transfer operation: all aboveground <br /> piping, tanks and fuel dispenser is enclosed within the cement berm. <br /> 4. Gasoline tank, per Joe Azevedo, is not in use.
