I a. Violation of Health and Safety Code section 25503.5(a), being a business that <br /> 2 handles a hazardous material or a mixture containing a hazardous material that has a quantity at <br /> 3 any one time during the reporting year equal to, or greater than, a total weight of 500 pounds, or <br /> 4 a total volume of 55 gallons, or 200 cubic feet at standard temperature and pressure for <br /> 5 compressed gas, and failing to establish and implement a business plan for emergency response <br /> 6 to a release or threatened release of a hazardous material for each of the Covered Facilities; <br /> 7 b. Violation of Health and Safety Code section 25504(b), business plan failing to <br /> 8 include emergency response plans and procedures in the event of a reportable release or <br /> 9 threatened release of a hazardous material, including but not limited to the following: <br /> 10 i. Immediate notification to the administering agency and to the appropriate local <br /> 11 emergency rescue personnel; <br /> 12 ii. Procedures for the mitigation of a release or threatened release to minimize <br /> 13 any potential harm or damage to persons, property, or the environment; <br /> 14 iii. Evacuation plans and procedures, including immediate notice, for the <br /> 15 business site; <br /> 16 C. Violation of Health and Safety Code section 25504(c), failing to train all new <br /> 17 employees and annual training, including refresher courses, for all employees in safety . <br /> 18 procedures in the event of a release or threatened release of a hazardous material, including, but <br /> 19 not limited to, familiarity with the plans and procedures specified in Health and Safety Code <br /> 20 section 25504(b); <br /> 21 d. Violation of Health and Safety Code section 25505, failing to submit a <br /> 22 business plan for emergency response to a release or threatened release of hazardous material for <br /> 23 each of the Covered Facilities, to the administering agency. Said violation was knowingly <br /> 24 committed after reasonable notice; <br /> 25 e. Violation of Health and Safety Code section 25505(e)(2), failing to annually, <br /> 26 by January 31 of each year, submit a form,provided by the administering agency, that certifies <br /> 27 that the handler has included, and maintains as current, in the business plan, all other <br /> 28 information required by Health and Safety section 25504; <br /> 7 <br /> CONSENT JUDGMENT,ORDER FOR PERMANENT INJUNCTION AND CIVIL PENALTIES <br />
