1 Environmental Prosecutions Unit, within twenty(20) days of the entry of the Consent <br /> 2 Judgment. This TWENTY FIVE THOUSAND DOLLARS ($25,000.00) shall be <br /> 3 allocated as follows: <br /> 4 i. FIFTEEN THOUSAND DOLLARS ($15,000.00)payable to the <br /> 5 California Hazardous Materials Investigators Association(CHMIA) for <br /> 6 enforcement training programs. This entire FIFTEEN THOUSAND DOLLARS <br /> 7 ($15,000.00) shall be used by CHMIA to assist the Western States Project in <br /> 8 conducting training in conjunction with the United States Environmental <br /> 9 Protection Agency California Advanced Environmental Crimes Training <br /> 10 Program (AECTP); <br /> 11 ii. TEN THOUSAND DOLLARS ($10,000.00) payable to the California <br /> 12 Hazardous Materials Investigators Association(CHMIA) for enforcement <br /> 13 training programs. The entire TEN THOUSAND DOLLARS ($10,000.00) shall <br /> 14 be used by CHMIA to assist the Western States Project in improving the training <br /> 15 facilities in conjunction with California Specialized Training Institute (CSTI) for <br /> 16 the AECTP courses; <br /> 17 6. PERMANENT INJUNCTIVE RELIEF <br /> 18 Pursuant to provisions of Health and Safety Code sections 25516, 25516.2,Business and <br /> 19 Professions Code section 17203, and the Court's equitable powers, Settling Defendant shall <br /> 20 undertake the following actions related to the Covered Facilities and any other facility of <br /> 21 Settling Defendant which maintains on site, for any given period of time, hazardous material or <br /> 22 mixture containing a hazardous material, after entry of the Consent Judgment. Any violation of <br /> 23 the permanent injunction required by this Consent Judgment shall be considered separate and in <br /> 24 addition to any violation of the statutory or regulatory requirements. <br /> 25 Settling Defendant with actual or constructive knowledge of this injunction, only in so <br /> 26 far as they are doing business in the State of California, are pursuant to Health and Safety Code <br /> 27 section 25516 and pursuant to Business and Professions Code section 17203 hereby <br /> 28 permanently enjoined from: <br /> 6 <br /> CONSENT JUDGMENT,ORDER FOR PERMANENT INJUNCTION AND CIVIL PENALTIES <br />
