REGULATORY CHANGES. <br /> 3 Nothing in this Consent Judgment shall excuse Settling Defendant from meeting any <br /> 4 more stringent requirements which may be imposed hereafter by changes in applicable and <br /> 5 legally binding legislation or regulations. <br /> 6 12. AUTHORITY TO ENTER CONSENT JUDGMENT. <br /> 7 Each signatory to this Consent Judgment certifies that he or she is fully authorized by the <br /> 8 Party he or she represents to enter into this Consent Judgment, to execute it on behalf of the <br /> 9 Parry represented, and to legally bind that Party. <br /> 10 13. NON-DISCHARGEABILITY OF OBLIGATIONS <br /> 11 Any payments required by Settling Defendant pursuant to this Consent Judgment are not <br /> 12 dischargeable in bankruptcy. <br /> 13 14. ABILITY TO INSPECT AND COPY RECORDS AND DOCUMENTS <br /> 14 On reasonable notice and subject to all of the defenses Settling Defendant would have to <br /> 15 requests for documents made by subpoena or other formal legal process or discovery employed <br /> 16 by Plaintiff, any duly authorized representative of any of the undersigned offices representing <br /> 17 the Plaintiff shall be permitted to inspect and copy such records and documents in the possession <br /> 18 of Settling Defendant as may be reasonably necessary to determine whether Settling Defendant <br /> 19 is in compliance with the terms of this Consent Judgment. Nothing in this paragraph is intended <br /> 20 to require access to or production of any documents which are protected from production by the <br /> 21 attorney-client privilege, attorney work product doctrine, or any other applicable privileges, <br /> 22 exemptions, or immunities afforded to Settling Defendant under law. <br /> 23 15. ENFORCEMENT OF JUDGMENT. <br /> 24 In the event that a Party brings an action to enforce any of the terms of this Consent <br /> 25 Judgment, the prevailing Party shall be entitled to its reasonable costs, including attorney fees <br /> 26 and costs, including any costs for expert witnesses or other costs. <br /> 27 16. PAYMENT OF LITIGATION EXPENSES AND FEES. <br /> 28 Settling Defendant shall pay its own attorney fees, expert witness fees and costs, and all <br /> to <br /> CONSENT JUDGMENT,ORDER FOR PERMANENT INJUNCTION AND CIVIL PENALTIES <br />
