This additional testing will require forty-five <br />(45) days to complete. Therefore, Buyer hereby notifies Escrow Officer that until such testing is <br />complete and the results reviewed by Buyer, Buyer can not remove the Environmental <br />Contingency. Therefore, Buyer will not waive contingencies, the Due Diligence expiration date <br />shall be extended for forty-five (45) days, and Buyer's deposit shall remain fully refundable until <br />this matter is resolved and approved by both Buyer and Seller in writing. <br />Respectfully Submitted, <br />Red Mountain Retail Group, Inc.
