prohibited when the disposal is at a facility which does not have a permit from the <br />department issued pursuant to this chapter, or at any point which is not authorized <br />according to this chapter. <br />4 A total of seventeen non -empty containers of automotive fluids were found in <br />three trash cans throughout the facility. One of the trash cans had automotive <br />fluids spilled into it. <br />Title 22, CCR 66265.16(d) Personnel training records incomplete. The owner or <br />operator shall maintain the following documents and records at the facility: <br />(1) the job title for each position at the facility related to hazardous waste management, <br />and the name of the employee filling each job; <br />(2) a written job description for each position listed under subsection (d)(1) of this <br />section. This description may be consistent in its degree of specificity with <br />descriptions for other similar positions in the same company location or bargaining <br />unit, but shall include the requisite skill, education, or other qualifications, and duties <br />of facility personnel assigned to each position; <br />(3) a written description of the type and amount of both introductory and continuing <br />training that will be given to each person filling a position listed under subsection <br />(d)(1) of this section; <br />(4) records that document that the training or job experience required under subsections <br />(a), (b), and (c) of this section has been given to, and completed by, facility <br />personnel. <br />-> Personnel training records were not found on site during the October 19, 2011, <br />hazardous waste inspection. <br />Title 22, CCR 66265.31 Facility not maintained to minimize the release of a <br />hazardous waste. Facilities shall be maintained and operated to minimize the <br />possibility of a fire, explosion, or any unplanned sudden or non -sudden release of <br />hazardous waste or hazardous waste constituents to air, soil, or surface water which <br />could threaten human health or the environment. <br />4 Several areas in the shop were found with spillage of automotive fluids that <br />were not addressed during the September 19, 2012, hazardous waste inspection. <br />Title 22, CCR 66265.51 Failed to prepare a contingency plan. Each owner or <br />operator shall have a contingency plan for the facility. The contingency plan shall be <br />designed to minimize hazards to human health or the environment from fires, <br />explosions, or any unplanned sudden or non -sudden release of hazardous waste or <br />hazardous waste constituents to air, soil, or surface water. <br />4 A contingency plan was not found on site during the October 19, 2011, <br />hazardous waste inspection. <br />Title 22, CCR 66265.173(a) Failed to keep containers of hazardous waste closed <br />except when adding or removing hazardous waste. A container holding hazardous <br />waste shall always be closed during transfer and storage, except when it is necessary to <br />add or remove waste. <br />4 A drum of waste antifreeze was found open during the September 19, 2012, <br />hazardous waste inspection. <br />3 <br />
