PRC § 42961.5 <br /> 19 Counts of submitting incomplete or incorrect Manifest Forms x$100($100-$500/first <br /> offense)_$2,000 <br /> Total sum of Penalties=$2,400 <br /> Statement of Facts: <br /> Manifesting Errors <br /> In August 2007,the Tire Hauler Compliance Section of the California Integrated Waste Management <br /> Board(CIWMB) initiated an audit of waste tire haulers with very high manifest error rates. <br /> GUTIERREZ TIRES, located at 919 North Wilson Way, Stockton,CA 95205,was included in this <br /> list and was assigned to Claire Miller,Integrated Waste Management Specialist, CIWMB,Tire <br /> Hauler Compliance Section, for follow up.An audit of the Comprehensive Trip Log forms(CTLs) <br /> submitted to CIWMB between April and July of 2007 was conducted. Of the 19 forms used by the <br /> company during April and July 2007, all the forms contained at least one error; such as incorrect <br /> hauler Tire Program Identification Numbers(TPID), missing load type and load amounts&dates. <br /> Ten of the sampled forms are provided as Attachment 1. The percentage of errors was calculated by <br /> taking the total number of forms containing errors divided by the total number of forms submitted, <br /> which equaled 100%(this calculation reflects that every form had at least one error, not that every <br /> entry on each manifest was incorrect). An acceptable error rate established by the CIWMB is less <br /> than 2%. <br /> On August 9,2007,the Tire Hauler Compliance Section mailed GUTIERREZ TIRES, a letter <br /> informing them of the aforementioned errors, illegible entries, and omissions on their CTL forms, and <br /> that they would need to exercise more care when submitting future CTL forms in order to avoid <br /> possible enforcement action. The letter also indicated that a follow-up audit would be conducted <br /> within the next few months to determine their compliance with the CTL requirements(Attachment 2). <br /> In December 2007,a follow-up audit of CTL forms submitted by GUTIERREZ TIRES,to CIWMB <br /> between August 15, 2007 and December 31,2007 was conducted to determine whether they achieved <br /> compliance with the CTL requirements. The follow-up audit still revealed numerous errors, illegible <br /> entries, and omissions. Of 19 CTL forms submitted, all of the forms contained errors,which again <br />
