Gutierrez Tires <br /> TPID NO: 1319265 <br /> Page 3 of 6 <br /> included incorrect hauler TPID numbers,missing load types and load amounts and dates(Attachment <br /> 3). The percentage error rate equaled 100%. <br /> In summary, a Letter of Violation was mailed to GUTIERREZ TIRES on August 9, 2007,notifying <br /> GUTIERREZ TIRES of the waste tire manifesting requirements;which included manifest training <br /> invitations that were extended to the hauler.Additionally, all registered tire haulers were mailed a <br /> new CTL Training CD on June 1,2007,to further explain the manifesting requirements. <br /> Unregistered Hauling <br /> On January 30, 2008,Ms.Miller,was provided information by Mr. Cambridge,that GUTIERREZ <br /> TIRES violated Public Resources Code(PRC) §42951,by hauling waste/used tires without the <br /> required waste tire hauler registration. <br /> A review of the Waste Tire Management System(WTMS)revealed that GUTIERREZ TIRES <br /> became registered as a tire hauler on May 31, 2007 and maintained tire hauler registrations since that <br /> time; however,they did not renew their 2008 registration until January 10, 2008. In October 2007, a <br /> renewal application package was sent to the hauler requiring them to renew their registration for 2008 <br /> as their current registration would expire on December 31,2007.The hauler application for 2008 <br /> along with Surety Bond and Renewal Letter are provided as Attachment 4&5,respectively. <br /> In addition,the hauler was also provided with a"Zero Tolerance"letter in the application package <br /> which stated that the CIWMB would not be tolerant of haulers continuing to haul waste or used tires <br /> without current CIWMB registration.The"Zero Tolerance"letter is provided as Attachment 6. <br /> The operator failed to renew their registration before this time period. A cancellation letter dated <br /> January 2, 2008 was sent to the hauler,advising that they were cancelled and they were no longer <br /> allowed to haul 10 or more waste/used tires until such time they became registered again. A copy of <br /> the Cancellation Letter and mailing affidavit are provided as Attachment 7. <br /> GUTIERREZ TIRES hauled waste/used tires on one occasion as shown on the table below,while <br /> they were not registered as a waste tire hauler.The CTL form is provided as Attachment 8. <br /> Transaction CTL Receipts Passenger Tire Equivalents <br /> Date A, B, C <br /> 1/2/08 3561271 B 100 Tires <br /> Evidence List(Attached to Memo): A list of attachments that support the statements above. <br /> 1.
