G, Stockton Program: APSA SUMMARY OF VIOLATIONS CLASS I,CLASS II, or MINOR-Notice to Comply) "The following issues were noted based on the review of the SPCC Plan (submitted in response to the October 14, 2011 inspection)." -- The Professional Engineer (PE) certification is incomplete and includes only the PE stamp and signature. The PE certification must include all of the aspects in 40 CFR Part 112.3(d)(1), including attesting that the PE is familiar with 40 CFR 112, he or his agent has visited and examined the facility, the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, procedures have been established for required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a complete PE certification for the facility's Spill Prevention Control and Countermeasure (SPCC) plan. -- According to the cover sheet, the SPCC Plan was last reviewed on August 29, 2005. No review documentation was included in the Plan. A review and evaluation of the plan must be conducted at least once every 5 years. As a result of this review and evaluation, the SPCC Plan must be amended within 6 months of review, and recertified by a professional engineer if any technical amendments were made. You must document your completion of the review and evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan, or in a log or appendix to the Plan. The following words will suffice: "I have completed the review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result." Immediately a review of the facility SPCC Plan and make any necessary amendments, including all necessary documentation of the Plan reviews and ensure that future Plan reviews are properly documented. -- The SPCC Plan does not follow the order or requirements in 40 CFR Part 112, and a cross-reference was not provided. If you do not follow the sequence specified in 40 CFR 112 for the Plan, you must prepare an equivalent Plan and supplement it with a section cross-referencing the location of requirements in 40 CFR 112 and the equivalent Plan. Immediately amend the Plan to include a cross- reference or to follow the required sequence. -- A written management approval section was not included in the SPCC Plan. The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the plan. Immediately obtain required management approval for the SPCC Plan for this facility. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
