Lodi,CA 95240 <br /> 800-964-1080 RECFD <br /> 7.0 SCHEDULE: The Purchaser and TANKNOLOGY shall, within 30 days after acc UOE <br /> Proposal,develop a mutually acceptable work schedule. <br /> JUN 2'0 2014 <br /> 8.0 SUBSURFACE STRUCTURES: It is understood by the Purchaser and Tanknology that <br /> �eyxcavation <br /> and drilling present an inherent risk toward damage to unknown subsurfacEP�� c��1hH1�Z}will not <br /> egT <br /> be responsible for damage to subsurface piping, conduit or other subsurfaces H <br /> during the installation process; unless said piping, conduit runs, and other subsurJQE fearly <br /> identified and accurately located by the purchaser prior to commencement of the installation. A signed copy <br /> of the site specific "Drilling and Excavation Plan" must be reviewed and signed by the purchaser prior to <br /> commencement of work herein described. The executed Excavation and Drilling Plan shall be considered an <br /> integral component of the mutual agreement to perform work. In the event that subsurface piping or conduits <br /> are struck during drilling or excavation activities,work will be suspended and the purchaser will immediately <br /> be contacted to determine the appropriate course of action to accomplish repairs. <br /> 9.0 WARRANTY: All equipment provided by Tanknology,as part of this proposal will be warranted per <br /> the manufacturer. All workmanship is warranted for one year. This warranty, unless otherwise amended in <br /> writing by TANKNOLOGY, does not extend to other miscellaneous products, which may be used in <br /> conjunction with the TANKNOLOGY'S cathodic protection system(s). <br /> To request warranty service,Purchaser shall immediately,and in any event within five business days after the <br /> event causing the warranty claim, notify TANKNOLOGY of any claim in writing and give adequate and <br /> reasonable information and opportunity for TANKNOLOGY to evaluate the claim and recommend <br /> appropriate corrective action. Any notice to be given hereunder may be given orally provided that within not <br /> more than five days thereafter it is fully confirmed in writing. As Purchaser's sole and exclusive remedy <br /> under this warranty,TANKNOLOGY may elect to provide replacement parts or replacement units and make <br /> necessary repairs,or TANKNOLOGY may elect to refund the amount paid by Purchaser. <br /> In the event that corrective action is deemed to be TANKNOLOGY'S responsibility and TANKNOLOGY <br /> elects to provide replacement parts or replacement units,parts or replacement units for necessary repairs shall <br /> be provided by TANKNOLOGY,at no cost to the Purchaser. Although no billing will be submitted on such <br /> parts or replacement units,cost shall be based as per standard pricing schedules. Materials and replacement <br /> equipment plus reasonable associated labor costs shall not, in aggregate,exceed the total lump-sum price of <br /> this proposal/contract. TANKNOLOGY'S TOTAL LIABILITY UNDER THIS WARRANTY IS LIMITED <br /> TO THE PROPOSAL AMOUNT, AND THE WARRANTY DOES NOT EXTEND TO ANY <br /> SUBSEQUENT OR CONSEQUENTIAL DAMAGES OR CLAIMS WHATSOEVER. THE REMEDY SET <br /> FORTH IN THIS SECTION 10.0 IS PURCHASER'S SOLE AND EXCLUSIVE REMEDY AND THE <br /> MAXIMUM EXTENT OF TANKNOLOGY'S LIABILITY UNDER THIS WARRANTY. <br /> EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION 10.0,TO THE MAXIMUM EXTENT <br /> PERMITTED BY LAW TANKNOLOGY MAKES NO WARRANTY, REPRESENTATION OR <br /> CONDITION OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THIS <br /> AGREEMENT OR THE SERVICES RENDERED AND/OR EQUIPMENT PROVIDED PURSUANT <br /> HERETO. TO THE MAXIMUM EXTENT PERMITTED BY LAW,TANKNOLOGY DISCLAIMS <br /> ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED <br /> WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. <br /> 10.0 INSURANCE: Upon acceptance of this proposal, at the request of the Purchaser,TANKNOLOGY <br /> will provide the Purchaser with a Standard Certificate of Insurance, which delineates its normal insurance <br /> coverage,applicable to the proposed work(Workman's Compensation,General Liability and Auto Liability). <br /> Such insurance is continuously in force and is characteristically applicable to the technical/engineering <br /> services proposed. In the event the Purchaser requires additional or special insurance coverage, over and <br /> above TANKNOLOGY'S normal coverage, applicable short-term additional coverage will be obtained for <br /> 3 <br />
