In fact, on October 20, 1995, Mr. Irey represented to the <br /> court that "_it is completely separate. ... It has nothing to do with the Kasson Road � <br /> property whatsoever." <br /> irk <br /> Please be advised that the activity at Kasson Road, with regarding to the bank <br /> protection work and the filling in of the pit area, are pursued by us under the supervision <br /> of the Army Corps of Engineers under the express instructions of a settlement agreement E <br /> with the U.S. Attorney in U.S. v. Alegre. <br /> Your refusal to discuss the issue of what material-would be appropriate and <br /> acceptable to the San Joaquin County Public Health Department, Environmental Division; <br /> is viewed as an inappropriate response of a public agency,to a legitimate request for <br /> information. Your insistence that I discuss this matter with the Deputy District Attorney ' <br /> is completely inappropriate. It is my understanding that Public Health regulationsare only <br /> ' within the purview of the District Attorney's office when.enforcement is an issue, and <br /> even then the matter must be referred by your agency following administrative procedures <br /> attempting to gain compliance.
