Part of the conditions per the <br /> SPCC plan and per guidance from the US EPA is that the tank be visibly inspected on all sides, including the <br /> bottom. The 2,100 gallon diesel tank has a concrete containment around it that hinders inspection of the bottom of <br /> the tank. The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and <br /> implement a Spill Prevention Control and Countermeasure Plan (hereafter "SPCC Plan"or"Plan")," in accordance <br /> with CFR § 112.7 and any other applicable. Provide a statement that describes how the tank is inspected and which <br /> is in compliance with the environmental equivalence as outlined in the Plan of amend to reflect current procedures. <br /> This is a minor violation. <br /> 301 CFR 112.5(a) Failed to amend Plan as necessary. <br /> The two lube stock tanks, identified as L1 and L2 in the SPCC plan, no longer store lube stock and contain another <br /> material. The area referred to as "the old shop"was observed with six 55 gallon heat transfer oil containers, these <br /> tanks are not addressed in the SPCC plan. In the area referred to as the "truck shop", two 250 gallon containers of <br /> new oil were observed, these tanks are not addressed in the SPCC plan. The SPCC plan indicates that two 55 <br /> gallon drums of waste oil are in the truck shop, a total of five 55 gallon drums of waste oil were observed. All tanks <br /> not addressed in the SPCC plan were stated to have been at the facility longer than six months. A 1000 gallon <br /> gasoline tank is mentioned in the SPCC plan, it was stated that the tank is no longer at the facility. The Spill <br /> Prevention, Control, and Countermeasure (SPCC) Plan must be amended when there is a change in the facility <br /> design, construction, operation, or maintenance that materially affects its potential for a discharge, within 6 months <br /> of the change, and implemented as soon as possible, not later than 6 months following preparation of the <br /> amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the <br /> procedures and policies currently in place at the facility. <br /> This is a repeat violation, Class Il. <br /> 609 CFR 112.7(a)(3vi), 112.7(a4) Plan failed to adequately contain procedures for reporting a discharge. <br /> The 24 hour phone number for the San Joaquin County Environmental Health Department, the local CUPA, is <br /> reported as (209) 223-6439. This is not the correct 24 hour phone number for the local CUPA, the 24 hour number <br /> is(209)468-3420. The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not provide information <br /> and procedures to enable a person to adequately report a discharge. If a response plan was not submitted to the <br /> Regional Administrator, this information must be included in the SPCC Plan.
