On 25 April 2000, staff sent you a second
notification letter requiring documentation of your compliance with the APSA. A third notification letter
was sent on 22 August 2001. You have not complied with these requirements.
California Water Code Section 13267 authorizes the Regional Board to require submission of technical
reports under specified circumstances. The technical report required in this letter is necessary to
demonstrate compliance with the APSA. The Irrigation Store dba Rain for Rent that you operate contains
aboveground storage tanks subject to the APSA. Pursuant to Water Code Section 13267, by 15 July 2002,
the Irrigation Store dba Rain for Rent is required to submit a technical report including a certified SPCC
plan and proof that you filed a storage statement and fee for your aboveground tanks with the State Board.
Failure to submit this information as required could subject you to administrative civil liability or other
enforcement action in accordance with California Water Code Section 13268. If you have any questions
regarding these requirements or need additional information, you may contact G. Arnold Inouye at
(916) 255-3029.
r4 R Rx
I
THOMAS R.
