Following the <br />UST removals, the San Joaquin County Environmental Health Department (County) made numerous requests to <br />Mr. Ralph White, and to Mr. Peter Bui to submit a plan of work to investigate the extent of this contamination <br />(copy of 19 December 2001 County letter attached). Based on your failure to submit the required plan of work, <br />the County has referred the site to the Regional Water Quality Control Board for regulatory enforcement. <br />As presented in Title 23, Division 3, Chapter 16 of the California Code of Regulations, UST owners and <br />operators where an unauthorized release has been identified are required to conduct site characterization, <br />quarterly monitoring, and corrective actions, and submit quarterly reports to the local agency until the County or <br />Regional Board issues a No Further Action Required letter for the site. <br />Therefore, by 20 May 2002, please submit a plan of work to characterize the lateral and vertical extent of soil <br />and groundwater contamination identified at your site. Failure to comply with this request may subject you to <br />formal enforcement actions including administrative civil liability (monetary fines). <br />Please note that a state fund is available to assist UST owners and operators with the costs associated with the <br />investigation and remediation of underground storage tank releases.
