The responsible parties are jointly responsible and what portion of financial
responsible assigned to each responsible party is usually decided by parties involved,
although prior to litigation arbitration is recommended.
As I indieatl should Spanos jet Center wish to contest the identification as a responsible
party, Dorothy Jones or Mike Harper of the State Nater Resources Control;Board should be
contacted in writing. Prior to issuing directives, San Joaquin County Environmental Health
under contract with the Mate Vater resources Control Board and utilizing language
specified by the Stag Vater resources Control Board, provides notice toeach responsible
party that remedial action is required. Your legal counsel, Mr. Barbour, has taken the
position that notice provided is insufficient.
Fnvir®omental Health strives to work cooperatively and to behave towards all persons with
respect, courtesy and responsiveness I understand that there are considerable Cos
associated with investigating and remediating contamination from underground storage
tanks
and that those not responsible would not choose to incur such costs. As;l indicated there
are three definitions of responsible parties: tank owner, tank operator and property owner,
A Division of San Joaquin county Health Care Services
