Mr. De Anda was speaking to Sam Martinez and Steve Edgar about the draining of wastes onto the <br /> ground causing possible contamination of state waters. Mr.Edgar spoke up and denied the wastes <br /> came from Earth Grains. He told Mr. De Anda the wastes�ame from drainage across Airport Way. <br /> Mr. De Anda replied, "this drainage ditch basically drains your facility and you would be better off <br /> controlling it now". Mr. Martinez spoke up, " It will be done". He continued saying, "we are not <br /> denying we did this. We have accepted the fact that we have done this and we are in the process of <br /> cleaning it up. Tish has been here,and Dennis (of OES) has been here (a reference to my previous <br /> inspection on July 27, 1990). We are in the process of getting bids to cleanup". <br /> Larry Williams told Mr. Martinez he wanted to look at the drains surrounding Earth Grains before <br /> it got dark. I accompanied Larry through the asphalt area noting drain locations. (see inspection <br /> report map). There were three water drains on the south side of the Earth Grains plant near the <br /> fence. Also, four water drains on the east side of the Earth Grains plant. About 50 feet from the <br /> southeast corner of the Earth Grains building was a large storm drain with a manhole cover. Larry <br /> removed the manhole cover to expose a drain about two and one half(2 1/2) feet in diameter. The <br /> bottom of this drain was covered with a dark oily sludge. The sludge was similar in appearance to <br /> the sludge in the drainage ditch. Visible in the bottom of this drain were two smaller drain pipes one <br /> running north to south,and the second running east to west towards the pipe drainage ditch. It was <br /> too dark to obtain photographs of this drain. (see inspection report map). <br /> 4:30 p.m. <br /> I left the site after telling Sam Martinez I would be issuing Earth Grains a "Notice to Abate"to cease <br /> and desist the disposal of wastes onto the ground. Mr Martinez stated that they would not drain <br /> anymore wastes onto the ground. I told Mr. Martinez I still had to issue the "Notice to Abate". <br /> November 28, 1990 @ 2:00 p.m. <br /> Doug Wilson,Supervising REHS,and I returned to Earth Grains to complete the November 27,1990 <br /> inspection. Steve Edgar met Doug Wilson and I and escorted us out to the drainage ditch. Sam <br /> Martinez was scooping out waste from the cistern with a hoe,putting it into a bucket,and finally into <br /> a 55 gallon drum. The waste Mr. Martinez was scooping out had a lumpy grey appearance. There <br /> was a cooking oil odor to the waste. I informed Mr.Martinez he needed to label the drums of waste <br /> material as hazardous until the laboratory analysis determined it's status. <br /> Mr. Martinez and Mr. Edgar escorted Mr. Wilson and I on a tour of the Earth Grains plant. There <br /> is a truck wash and repair shop in the back (west side) of the plant. This truck wash has an oil/sand <br /> separator to receive the wash waters. It was not clear where the oil/sand separator drains. Doug <br /> Wilson requested Steve Edgar to send San Joaquin Public Health Services-Environmental Health <br /> Division copies of their waste oil and tank pumping manifests. <br /> Before departing Earth Grains I issued a second notice to abate and Mr. Martinez signed the notice. <br /> (NOTE: the first notice was issued on July 27, 1990).
