According to Mr. Kitagawa, the filters from the mold release room are vibrated until
the solids fall off and accumulate on the floor. The solid is then placed in the solvent wipes drum on site.
-Used oil filters are being managed as "excluded recyclable materials" but are being labeled on site as "hazardous
waste"with full hazardous waste labeling.
-Fluorescent dye being rinsed into an accumulation tank in the small room near the maintenance shop in Building 1.
Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop improper
disposal of these wastes, make a hazardous waste determination for the wastes listed, and manage them according
the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how these
wastes were managed.
This is a Class II violation.
110 CCR 66265.53 Failed to maintain a hazardous waste contingency plan onsite and submit to required agencies.
Copies of the contingency plan have not been mailed to any emergency agencies. A copy of the contingency plan
and all revisions shall be submitted to all local police departments, fire departments, hospitals, and State and local
emergency response teams that may be called upon to provide emergency services. Immediately submit revised
copies of the contingency plan to all required agencies.
This is a Class II violation.
111 CCR 66265.54 Contingency plan not current.
The contingency plan on site included evacuation contact information for C. Alvarez; according to Mr. Kitagawa, she
has not been with the company in approximately a year. The contingency plan shall be reviewed and immediately
amended, if necessary, whenever:
-applicable regulations are revised;
-the plan fails in an emergency;
-facility changes in design, construction, operation, maintenance, or other circumstances that increases the
potential for fires, explosions, releases of hazardous waste, or changes the response necessary in an emergency;
-the list of emergency coordinators changes; or
-the list of emergency equipment changes.
Immediately amend the contingency plan, and submit a copy to the EHD for review.
This is a Class II violation.
Page 4 of 10
