The following is an itemized list of hazardous waste violations that have not been <br /> addressed for JUANS AUTO REPAIR as of August 10, 2015. <br /> Open violations from June 15, 2015 inspection <br /> Violation#116 - Failed to submit a written response within 30 days of receiving an inspection report. <br /> An inspection was last done on November 16, 2012 and an inspection report was issued identifying information to be <br /> submitted to bring this site into compliance. This information was required to be submitted by December 16, 2012. <br /> deficiency letter was issued on March 22, 2013. This information has not been received resulting in a non-compliant <br /> status for this facility. The outstanding violations include: <br /> -CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste <br /> -CCR 66262.34(d) Stored hazardous waste on site greater than 180 days <br /> An operator that receives an inspection report shall have 30 days to submit a written response that includes a <br /> statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a <br /> written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an <br /> inspection report. <br /> Violation#202 -Disposed or caused disposal of HW at an unauthorized point. <br /> According to Mr. Rick Morga, metal fines generated from metal grinding are being recycled as scrap metal. No <br /> disposal records were available for the recycling of the metals fines. During the routine inspection conducted <br /> November 16, 2012, Ms. Nadine Morga stated that the metal fines would be handled as hazardous waste from then <br /> and would be disposed of by Evergreen Environmental. Hazardous wastes shall be disposed of only by transportatic <br /> to a permitted hazardous waste treatment, storage, and disposal facility(TSDF). Immediately cease disposal of <br /> hazardous waste metal fines as recyclable scrap metal and ensure that all future waste is hauled by a licensed <br /> hazardous waste transporter to a permitted TSDF. <br /> Violation#403 -Failed to keep hazardous waste containers closed except when adding or removing <br /> hazardous waste. <br /> The used oil tank was observed with a large rectangular piece cut from the top and folded back. According to Ms. <br /> Morga, this was done at the request of the hazardous waste hauler to allow easier access for pumping out the waste <br /> All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately <br /> close this container and ensure all hazardous waste containers are closed when not adding or removing waste. <br /> Violation #406 -Contaminated container not marked with date emptied or managed within one year of <br /> being emptied. <br /> A 55 gallon black steel drum which previously held used antifreeze was observed outside the shop with no empty <br /> labeling. A 55 gallon blue steel drum and a 20 gallon yellow steel drum were observed in the hazardous waste storai, <br /> area with empty labeling placed on them during the 2012 inspection. The drums were labeled "empty 9/3/12". <br /> Containers larger than five gallons that previously held a hazardous material shall be marked with the date they were <br /> emptied and managed within one year of being emptied. Immediately mark and manage all empty containers per thi <br /> section. <br /> Violation#601 -Stored hazardous waste onsite greater than 180 days. <br /> A 55 gallon black steel drum of used absorbent was observed in the hazardous waste storage area. This drum was <br /> observed on site during the 2012 inspection. Facilities who generate less than 1000 kg of hazardous waste per mon <br /> and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. Immediately <br /> contact a licensed hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifes <br /> to the EHD. <br /> Page 1 of 2 <br />
