Immediately update the contingency plan for this facility to include all of the necessary information and submit a copy of the updated plan to the EHD by May 22, 2014. 122, 123, & 124. Manifest numbers 002920044SKS, 003324261 SKS, 003629111 SKS, 003824091 SKS, 003824308SKS were found without a signed off copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate copies of the missing manifests or prepare and submit an exception report to DTSC. By May 22, 2014, submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. 202. Oily sludge generated at this facility is being transported for disposal under the consolidated manifesting procedure by Safety-Kleen Systems. Inc. On multiple occasions this waste stream, which is being classified as "Non-RCRA Hazardous Waste Liquids (oily sludge water)", was transported to a disposal facility under the consolidated manifesting procedure. No person shall knowingly offer ineligible waste streams for transportation under the consolidated manifesting program. If generator does not generate more than 1,000 kilograms of waste per calendar month, then wastes listed in HSC 25160(c) (1) and HSC 25160(c)(2) may be manifested under the consolidated manifesting program. However, since this facility generates more than 1,000 kilograms per month and the generated oily sludge is not listed in HSC 25160(c)(1) or HSC 25160(c)(2) as one of the waste streams eligible for consolidated manifesting, this waste stream is not eligible for the consolidated manifesting procedure. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
