Broadway, Stockton Page 3 of 8 <br /> Program: Hazardous Waste <br /> Time of 2 Inspections: 3-10-09/ 3-20-09 <br /> Date of Final Inspection Report: 5-28-09 <br /> Notice of Violation, Class I Violations: #4 <br /> Notice to Comply, Minor Violations: #10, 12, 20, 21, 27, 30, 31, 32, 33, 78, 80, <br /> 82, 85, 86, 88, 89 <br /> #4 24189.5 HSC — Disposed or caused disposal of Hazardous Waste <br /> (HW) at unauthorized points (Class I Violation) <br /> At the time of both inspections, disposal of HW to the environment at <br /> several unauthorized points from multiple leaking or overfilled containers <br /> was observed. <br /> 1) South of the former Valley Shingle roofed-structure at above-referenced <br /> site (the site): <br /> ■ Two opened 55-gallon drums with no label, one leaking and the other <br /> over-filled with what appeared to be used oil, formed an oily puddle on <br /> the soil beneath a wooden pallet which the drum sat on. <br /> ■ One container with no label, possibly over 55 gallons, with hose <br /> attached to one side, is seen lying horizontally on metal supports over <br /> the above-mentioned oily puddle. <br /> ■ Four vehicular fuel tanks of varying sizes were seen sitting on top of <br /> HW impacted soil near the above-mentioned oil puddle. <br /> ■ Multiple containers including at least two removed vehicular fuel tanks, <br /> were seen inside two topless wooden crates near the above- <br /> mentioned oil puddle. Oil had leaked and soaked through the bottom <br /> and the sides of the wooden crate. The soil below the crate appeared <br /> to be impacted by HW. <br /> 2) Immediately outside (east and west) the Spingolo Trucking repair shop <br /> (the repair shop): <br /> ■ Twelve metal 55-gallon drums with no label and one polyethylene 55- <br /> gallon drum with no label, some with signs of leakage of what <br /> appeared to be used oil. The soil beneath many of the drums had <br /> been impacted by commingled leaks from the drums. Trails of oil <br /> leaking from the drums into a metal grate of what appeared to be an <br /> underground vault on the north side of the repair shop were seen. <br /> 3) At the trash pile east side of the repair shop, leaky abandoned <br /> machines were seen leaking oily waste to the environment. <br /> Immediately, cease disposal of HW to the environment. Properly dispose of <br /> contaminated soil pursuant to Title 22 Section 66262.11 HW determination, and <br /> provide all documentation within 30 days of this letter. <br />
