TRACY <br />May 28 2015 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />60b <br />CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. <br />Inside the shop is a five gallon container with a hazardous waste label which the owner confirmed is waste paint. The <br />company name and address on this container label is illegible The accumulation start date is marked as November <br />2013. All hazardous waste containers shall be marked with the following information: <br />- the words "Hazardous Waste" <br />- name and address of generator <br />- hazardous properties <br />- physical state <br />- composition (contents) <br />- accumulation start date <br />Immediately label these containers and ensure that all containers are marked with all the required information. Since <br />this container has been on site longer than 180 days, immediately contact a licensed hazardous waste hauler to <br />dispose of this waste under manifest and submit a copy of the manifest to the EHD. <br />This is a Class II violation. <br />5308 <br />CCR 66266.130 Failed to properly manage used oil and fuel filters. <br />Inside the shop on top of the blue 55 gallon drum of used oil are two drained used oil filters. These drained used oil <br />filters were not placed into a closed, rainproof container, and lacked a label that indicated "drained used oil filters" and <br />an accumulation start date. Used oil filters shall be drained of free-flowing oil, stored in a closed, rainproof container, <br />labeled as "drained used oil filters," and marked with an accumulation start date. Immediately containerize these <br />filters and label the container as "drained used oil filters", mark the accumulation start date, and ensure that all used <br />oil filters are managed in this way. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />On site to conduct a complaint and routine inspection. <br />Anonymous complaint alleged that this facility operator was wet sanding outside and allowing the waste to reach <br />the storm drain. At time of complaint inspection, wet sanding was observed but Do liquid wea contained on the <br />parking lot in front of the shop floor. Refer to routine hazardous waste inspection findings. <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 6-28-15. <br />Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br />online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
