Mr. Bill Buettner -3- (b) Permits are required for: (1) Injection wells that dispose of hazardous waste, and associated surface facilities that treat, store or dispose of hazardous. However, the owner and operator with an underground Injection Control Permit will be i deemed to have a Hazardous Waste Facility Permit for the injection well if they comply with the requirements of Section 66392 (Permits by Rule). (2) Treatment, storage or disposal of hazardous waste at facilities requiring an NPDES permit. However, the owner and operator of a publicly owned treatment works (POTWs) receiving hazardous waste will be deemed to have a permit for that waste if they comply with the requirements of Section 66392 (permit by rule for POTWs). (3) Barges or vessels that dispose of hazardous waste by ocean disposal and onshore hazardous waste treatment or storage facilities associated with an ocean disposal operation. However, the owner and operator of the barge or vessel will be deemed to have a permit for ocean disposal from the barge or vessel itself if they comply with the requirements of Section 66392 (Permits by Rule). Shinko Electric America is operating a treatment facility without a permit issued by the Department. II. Schedule of Correction Violation #1- Effective immediately, all containers used for the storage of hazardous waste shall be marked and labelled in accordance with Section 66508, Title 22 , California Administrative Code. Violation #2- Shinko Electric America may be a candidate for a variance from permitting requirements. Within 30 days of the receipt of this Report, submit a completed variance application to Charles A. White at the letterhead address. A variance application was left with Mr. Buettner at the time of inspection. When all violations have been corrected, please send written certification to this office. This certification shall contain the sample certification statement indicated on Attachment 1. The Department will conduct a reinspection of Shinko Electric America to verify compliance. The issuance of this Report of Violation and Schedule for Compliance does not preclude DHS from taking any administrative, civil, or criminal action as a result of the violations noted herein.
