Mr. Bill Buettner -2- <br /> (4) The generator complies with the requirements for owners or <br /> operators in Articles 19 and 20 and Section 67105. <br /> - Section 66508 (b) , Title 22, California Administrative Code <br /> (b) A generator who accumulates hazardous waste for more than 90 days <br /> is an operator of a storage facility and is subject to the requirements of <br /> Articles 17 through 32 and the permit requirements of Article 6 unless he <br /> has been granted an extension to the 90-day period. Such extension may be <br /> granted by the Department if hazardous wastes must remain on site for <br /> longer than 90 days due to unforeseen, temporary and uncontrollable <br /> circumstances. An extension of up to 30 days may be granted at the <br /> discretion of the Department on a case-by-case basis. <br /> Section 66508 (c) , Title 22, California Administrative Code <br /> (c) A label shall be maintained on all nonstationary containers in <br /> which hazardous wastes are stored. Labels shalt include the following <br /> information: <br /> (1) Composition and physical state of the waste. <br /> (2) Statement or statements which call attention to the particular <br /> hazardous properties of the waste (e.g., flammable, reactive, etc.). <br /> (3) Name and address of the person producing the waste. <br /> Shinko Electric America is storing hazardous waste in <br /> containers which are not marked or labelled. These <br /> requirements would also apply to the filter press bin if it <br /> is used to store hazardous waste. <br /> Violation #2, Section 66371 (a) , (b) , Title 22, California <br /> Administrative Code. <br /> (a) Permits are required for treatment, storage or <br /> disposal of hazardous waste. Owners and operators of hazardous <br /> waste facilities shell have permits during the active life <br /> (including the closure period) of the facility and, for any <br /> facility which closes after January 26, 1963, during any <br /> post-closure care period required under Section 67217, and <br /> during an compliance period specified under Section 67186, <br /> including any extension of that compliance period under Section <br /> 67186 (c). <br />
