i <br /> i <br /> 1 the delay. All such requests shall be in advance of the date on <br /> 2 which the activity or document is due. <br /> 3 3 . 22 . Extension Approvals. The Department shall grant the <br /> 4 request to extend the time for a reasonable period and specify in <br /> 5 writing a new schedule upon a showing by PG&E that good cause exists <br /> 6 for an extension. PG&E shall comply with the new schedule. <br /> 7 3 . 23 . Cost Liability. In addition to liability for oversight <br /> 8 costs, failure or refusal of PG&E to comply with this Order may make <br /> 9 PG&E liable for any governmental costs incurred, including those <br /> 10 payable from the Hazardous Substance Account or the Hazardous <br /> 11 Substance Cleanup Fund for any response action at the Site, as <br /> 12 provided in Sections 25359 and 25367 of the Health and Safety Code <br /> 13 and other applicable provisions of law. Cost recovery may also be <br /> 14 pursued by the Department under CERCLA. <br /> 15 3 .24 . Severability. The requirements of this Order are <br /> 16 severable, and PG&E and the Department shall comply with each and <br /> 17 every provision hereof notwithstanding the effectiveness of any <br /> 18 other provision. <br /> 19 3 . 25 . Modifications. PG&E and the Department may, by written <br /> 20 request, seek modification, termination or revision of this Order or <br /> 21 any portion of this Order or any program or plan submitted pursuant <br /> 22 to this Order at any time. This Order and any applicable program, <br /> 23 plan, or schedule may be modified, terminated or revised by mutual <br /> 24 written agreement of the parties at any time. Any modification to <br /> 25 this Order shall be effective upon issuance by the Department and <br /> 261 deemed incorporated in this Order. In addition, the Department <br /> 27 reserves the right to take additional enforcement action including <br /> PAPER 34 <br /> CALIFORNIA <br /> 3 iREV. 8.721 <br />
