Ths injunctive provisions of this Final Judgment are applicable to Defendant, its <br />subsidiaries and divisions, and any agent, employee, representative and all persons, corporations, or <br />other entities acting by, through, under, or on behalf of.Defendant and all persons in concert with or <br />participating with said Defendant with actual or constructive knowledge of this injunction, only <br />insofar as they are doing business in the State of California and confined to Defendant's <br />AUTOMOTIVE PARTS ASSEMBLY activities in the County of San Joaquin and elsewhere in the <br />State of California <br />3. Defendant, in the course of Defendant's AUTOMOTIVE PARTS ASSEMBLY activities, <br />I are pursuant to Health and Safety Code section 25100 et seq., hereby permanently enjoined from: <br />a. Disposing or causing the disposal of hazardous waste at a facility not permitted or <br />at a point which is not authorized, in violation of Health and Safety Code section 25189.5(x); <br />b. Failing to determine if that waste is a hazardous waste, in violation of California <br />Code of Regulations, title 22 section 66262.11; <br />c. Failing to maintain and operate facility to minimize the possibility of a fire, <br />explosion, or any unplanned sudden or non -sudden release of hazardous waste, in violation of <br />California Code of Regulations, title 22 section 66265.31; <br />d. Failing to equip the facility with an internal communications or alarm system <br />capable of providing immediate emergency instruction to facility personnel, in violation of California <br />Code of Regulations, title 22 section 66265.32(a); <br />e. Failing to equip the facility with a device, such as a telephone or a hand-held two- <br />way radio, capable of summoning emergency assistance from local police departments, fire <br />departments, or State- or local emergency response teams, in violation of California Code of <br />Regulations, title 22 section 66265.32(b); <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
