Any penalties or other relief sought by <br />Plaintiff for such violations or alleged violations shall be sought by noticed motion. Plaintiff shall <br />notify Defendants in writing of such alleged violations and shall meet and confer with Defendants <br />within twenty (20) business days of such written notice prior to filing any such motion. The Parties <br />shall negotiate in good faith in an effort to resolve any further penalty assessments or other relief <br />pursuant to this paragraph without judicial intervention. Defendants reserve all defenses in law and <br />equity. <br />13. If all the conditions listed in paragraph 11 above are met, then FIVE (5) .years from ,the <br />filing date of this document, the stayed penalty shall be suspended permanently. <br />14. The Court shall retain continuing jurisdiction to enforce the terms of this Final Judgment <br />and to address any other matters arising out of or regarding this Final Judgment. The Parties shall <br />meet and confer prior to the filing of any motion relating to this Final Judgment and shall negotiate in <br />good faith in an effort to resolve any dispute without judicial intervention. <br />15. In no event earlier than sixty (60) months following entry of this Final Judgment, any <br />party hereto may provide notice to the Court (which shall be served on all Parties) that the Permanent <br />Injunction provisions of Paragraphs 3, 4, and 5 of this Final Judgment will expire and have no further <br />force or effort ("Notice of Termination!). The Permanent Injunction provisions- of Paragraph 3, 4, <br />and 5 will be of no further force or effect sixty (60) days thereafter, unless Plaintiff files a motion <br />contesting the expiration of Paragraphs 3, 4, and 5 within sixty (60) days of receipt of the Notice of <br />Termination. In the event that such a motion is filed, none of the contested injunctive provisions.,of <br />0 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
