Ms. Thuy Tran July 19, 2011 <br />Response to the Two Minor Violations Issued by the San Joaquin County Environmental Health <br />Department to Lawrence Livermore National Laboratory, Site 300 EPA ID. No. CA2890090002 <br />Violation #2: <br />#999, Other [violation not listed on the inspection report form]. <br />CCR 66262.54. The contingency plan for this facility is outdated. The contingency plan located <br />by the WAA lists Rex Beach as one of the emergency coordinators. He has since retired <br />approximately one month ago. The contingency plan shall be reviewed, and immediately <br />amended, if necessary, whenever any of the following occur: <br />- applicable regulations are revised, <br />- the plan fails in an emergency, <br />- the facility changes in its design, construction, operation, maintenance, or other <br />circumstance in a way that materially increases the potential for fires, explosions, or <br />releases of hazardous waste or hazardous waste constituents, or changes the response <br />necessary in an emergency, <br />- the list of emergency coordinators changes, <br />- the list of emergency equipment changes. <br />Immediately amend the contingency plan for this facility to include the updated information, <br />maintain a current on site at all times. <br />Response: <br />The emergency coordinator table on page 7 (Attachment 2) of the Contingency Plan for Site <br />300 Waste Accumulation Area(s) was updated and inserted into the Building 883 Waste <br />Accumulation Area facility contingency plan immediately after the inspection. The updated <br />page was also distributed to off-site and on-site emergency response organizations pursuant to 22 <br />CCR 66265.53 (b). <br />Compliance Requirement: <br />Submit to SJC EHD within 30 days (7/20/11) <br />1. one copy of the completed "Return to Compliance Certification form, <br />2. a written corrective action statement for the above violations. <br />Response: <br />The completed RETURN TO COMPLIANCE CERTIFICATION is included with this submittal as <br />Attachment 3.
